    My friend has had a similar rejection letter to yourselves from Santander regarding a Debenhams store card. Has anyone taken this to the FLA & heard anything back?

    Have just completed FLA complaint form online. Not hopeful at all as they state they will not investigate if there is no new evidence other than that investigated by Santander/Debenhams Card lol.
    End of the road methinks ...........

    I'm having similar from Santander/Burton.

    My main argument against the PPI is that I was not employed at the time and had just finished school, way back in 1996. I also argued that I had not chosen PPI in my application. It was an in-store application and I know I wasn't working as I was in Burton to buy a suit for my first job interview lol when they pounced with the 10% off blah blah blah.

    About 6 weeks after my complaint letter they sent my original Credit Agreement back showing thet PPI had been ticked as requested. However it is plain to see that 2 different people had filled in this application form. You can see my nice neat writing, I was just 18 and this was my first line of credit so was filling it all in nice and neatly with all my details all in the spaces etc etc like the first page of your new exercise book at the start of the school year lol Then there is all these big ticks, not even in the box through all these other bits and pieces including the PPI sell, quite clearly filled in by the Shop Assistant.

    Go to the signatures and my signature all nice and neat in the box and then the Shop Assistant biq squiggles and loops all out of the box. Clear to see two different styles throughout the application form. Plus the signatures are on a different page to the PPI.

    Santander also asked me for a copy of my National Insurance Contributions for that year. When I phoned HMRC they said it would take 4 weeks. In Santanders letter to me they said if they did not hear from me they would close the complaint in 4 weeks so I wrote back to them immediately, recorded delivery, asking them to keep the complaint open as it would take 4 weeks to get a copy of the NICs and also highlighting the differences in style on the application form.

    Lo and behold 4 weeks later I get a letter from Santander closing the complaint and not even acknowledging the differences in style. Ironically my copy of the NICs arrived in the post the very same day lol

    So I have sent them a very unhappy customer reply with the NICs and a note assuming my last letter found its way into the bin lol and including a further copy of my previous letter for their records.

    Further to the above the PPI could have been ticked any time as there is no option for not wanting it. ie if there were two boxes, one for taking it and one for declining it and you tick which one you require. This form you just left blank if you did not want it which could have been ticked by anyone at any time after, especially if that certain someone was on a bit of commission :D

    In Santanders defence I have had success with an Alliance & Leicester Loan taken out in 2006 and managed to reclaim £1300 from Santander so not all bad.

    Overall I am finding relative success with loans and relative difficulties with Credit & Store Cards.
  • i have had a debenhams card since 1995 and have been paying ppi regularly. yes i should have cottoned on sooner but when i did contact to reclaim i was ask "what have you just noticed it??" Santander refused claim and i went to FLA - just heard today that they concur with Santander and i was given information relating to PPI at the time and they uphold the decision. NOT HAPPY!!!:mad::mad:
    Interestingly enough Santander told me that i received a telephone call re the PPI some 6 months after taking out the Debenhams card and that it was explained to me at that point. No recollection of that call and when i asked for details none were forthcoming.

    Just to say that you should now refer this to FOS who will look at it once the FLA have refused the complaint. Mine has been with FOS since the beginning of the year and I know it will be a long drawn out affair,with no guarantees of success but they are looking into these complaints.

    Good luck all.

    My hubby's GE Cap bank store card was also rejected, he received a letter to refer to the FLA.

    Think they just automatically reject if they were not regulated by the FSA as standard.
    So annoying!!!

    The FOS will take the case on, and mainly to check of the underwriter/insurer, as they may have been regulated, and they will then check any liabilities they may have had when the policies were sold.

    Keep at them. ;)

    MBNA refunded the PPI and interest they'd taken after the accounts were sold to them.

    I know this is an old post. But yours was an MBNA card thats why. The OP is about a store card, Santander bought out GE Capital (who did the store cards) and are not under FOS jurisdiction for sales prior to 14 Jan 12.
