UKPC charge not paid now debt recovery letter comes - what do I do?

  • I've had one of these tickets from UKPC after parking slightly out a marked bay (Due to a heap of rubbish in the next bay).
    After reading all of the postings on this thread I am tempted to just ignore the 'fine'....but.
    With the new laws on parking fines coming into effect on Oct 1st, specifically the point that they can pursue owner OR driver now, how do I stand?

    Exactly the same as before October 1st. The tickets are just as unenforceable. If you want to have fun, and to cost UKPC money, wait till they send you a PCN in the post (as it'll cost them £2.50 to get details from the DVLA), then appeal (doesn't really matter on the content on your appeal). When (that's not "if") it's rejected, you appeal to POPLA, which'll cost UKPC another £27+VAT. If you lose that appeal, it's back to normal operations, and you ignore everything. It makes no difference. The car park owner has not lost any money due to your parking on the line, so they cannot sue for anthing.

    Any chance of posting up the ticket itself (scrubbed of your personal details)? We are interested in the exact wording. If it doesn't meet certain criteria, then the whole registered keeper (note - not owner) liablility fails for them anyway.

    Is it your car? If it's a company/lease/hire car, then the actions you need to take are a little different.

    Did your parking incident occur after Oct 1st?

    All the new legislation says is that the PPC can pursue the Registered Keeper if they do not know who the driver was.

    The tickets themselves are still unenforceable contractual penalties. Parking over a white line hasn't caused them any tangible loss as far as I can tell. There is also a recent binding upper court decision that states that unless the parking company have proprietary interest in the land (i.e. they own it or lease/rent it), which they almost certainly won't, then they cannot form a contract with drivers in the first place, so cannot pursue damages in relation to any breach.

    Ignore it.

  • It did happen after Oct 1st. As a further complication, the car will soon be gone in two weeks time as I've part-exed it against a new car. I guess that i'm obliged to inform the car dealer.

    The UKPC remind of of that guy down south of England somewhere that stood in a car park for years and charged buses to park there, wnd when he weas not there one day, someone phoned up the council, and the council said the car park was free and not chargeable. LOL.

    I have also got a fine in Derry, I have had one letter and now another letter from a Debt Recovery co do I take the advice and ignore all correspondence. Will they go away eventually.

    All you are obliged to do is to notify DVLA of the change of registered keeper, in the usual way. DVLA should give the PPC the correct details based on the date of the change, but anyway I don't suppose the dealer will care if they accidentally get a threatogram from UKPC, it probably happens to them all the time.
