Sold a car by RIGHT CAR with no MOT - where do I stand?
Hi everyone,
Bought a car from Right Car last year and picked it up on 13th December 2011.
It is now due to be taxed at the end of this month so I dug out my Insurance details and MOT. When I looked at the MOT I realised it expired December 20th 2011 - so it had been sold to me with NO MOT and hasn't had one since December 2010.
I know people might say I should have checked but they handed me an MOT Certificate and I assumed it would be the correct one.
I have rang them and it MIGHT be getting sorted tomorrow but I need my car for work and have plans to go away at the weekend.
Can anybody let me know where I stand with this as I am very annoyed it hasn't been MOT'd since 2010!!!!

By law they have to sell you a car with AT LEAST 11 months MOT. Plus they told me it would have one and have admitted they're at fault.The more one gets to know of men, the more one values dogs.0

Inform Right Car that you have to have this sorted for the weekend, or you will hire a vehicle and send them the bill. It may work, but TBH I don't think you have the law on your side. If the car, as detailed in your original invoice/receipt, was shown as possessing a full MOT, you will have cover. If you cannot find it, or have no proof of this, I am afraid you have been well and truly shafted.
There is no requirement for a seller of a used vehicle to provide a full MOT. Was it advertised as such? If you saw it in the local paper, can you retrieve back copies?
Bear in mind that, if you had been unfortunate enough to have a traffic accident, or your vehicle had been picked up by Police Checks as having no MOT at the DVLA, your insurance would have been invalid and you would have had your car towed away, incurring a heavy fine and having to pay to retrieve the car. Whatever you do, do NOT use the car until this is sorted.
I am surprised that you have not been picked up by a Traffic camera.
In fact, as a retired workshop foreman, I am puzzled by this. I wonder if the garage gave you the wrong MOT? When I was involved in vehicle sales, I tried to make a point of finding all previous certificates and passing them on.I think this job really needs
a much bigger hammer.

Where did you obtain this information? I have never heard of that one before.

They sold you a car with a one week MOT not No MOT, which is quite bad for a dealer but not illegal. It may be their company policy to give at at least an 11 month MOT but there is no law on this.
Check online to see if it's MOTed. Hopefully they did do it before you bought it but just gave you to old MOT rather than the new one.0 -
I was told by another car dealership I went to before that dealerships have to provide a minimum of 11 months, private sellers do not.
I have spoken to them and they have admitted fault and have said they will sort it, but I am just worried about driving it there when it isn't MOT'd and also what will happen if they can't sort it tomorrow as I need my car as I have arrangements for the weekend.

Sorry but you are the one that never checked the documents you were given for 6 months.
As already said there is no law that says you need to put 11 months MOT on a vehicle in order to sell it, whoever told you that is either an idiot or was pulling your leg.
I strongly suspect that the garage forgot to put an MOT on it when they sold it to you and nobody double checked prior to you collecting it.
I am afraid I honestly don't understand people that treat driving a car in such a cavalier way as you do.
Everytime you drive a car on the road it is your responsibility to ensure it is legal to do so and in a good state of repair and has a current MOT etc.0
