Good grief
Take mulberry out of the title. Don't mess with spellings or capital letters. I was reading the Lush VERO me page the other day (as you do) and they don't tolerate 'Lush' or 'lush' used dishonestly.
Put it in the description and you'll probably be ok... but hell, if it could mean suspension, I think I'd be willing to think of another way to describe that colour.
Thought for the day: 'shabby chic' is a trademark with a VERO.My TV is broken!

I can understand why the VERO system exists, but in many cases it goes too far.
2 days before christmas I had 5 listings removed from ebay under the VERO program.
I should explain that I sell beds and mattresses on ebay.
Ebay said that Tempur had requested that the listings be removed as they were in breach of their intelectual rights. The fact is that none of the listings in any way mention Tempur, and our memory foam mattresses are in fact far superior to Tempur.
After a long and expensive telephone conversation (I was in Tenerife at the time) to my account manager, I convinced her that there was nothing at all wrong with my listings. My account manager then passed her findings on to ebay's legal department, who then contacted Tempur. After a long wait Tempur told ebay that it was the fact that I said that Visco Elastic Memory Foam was developed by NASA, and that Tempur mention this in their adverts. Their complaint was that I was using the same theme as them. The truth is that NASA did develop memory foam for the seats in the Apollo missions, and Tempur did manufacture it for them. However the patent has long expired, and now there are many companies who manufacture visc elastic memory foam (many to a better standard than Tempur). I told my account manager that if NASA don't want me to mention them, then I would change my listings, but Tempur have no right to have my listings removed.
It seems to me that as Tempur's market share is shrinking fast for a couple of reasons:
1) they are too expensive
2) they aren't as good as they try to make us believe (they came bottom in a which magazine report)
So I believe that for these reasons Tempur tried to get rid of any competition on ebay just before the very busy christmas period. By doing this Tempur were breaking the law, and ebay probably were too by the fact that they did not investigate the matter properly.
My account manager now seems to be trying to avoid me:mad:0 -

:eek: Fay you always give me something to think about. I have a standard phrase for a nick nack item I sell and use the word 'shabby chic', I'll have to watch that one now.

Back to the original situation: Remove the word from your title or don’t sell it on ebay. I’m not saying this or right or fair but it’s the way ebay works. It’s all automatic and if that means innocent people get removed then so be it (that’s my understanding of their policy).
I actually had to stop selling on ebay for this reason (and my business outgrew it yay). I started my business on ebay. My business was taking away from a large company and the only thing they could find fault (as my items were my own creation and no vero issues) was to say that Northern Ireland is not part of the UK and in me saying that Northern Ireland was part of the UK I was lying about my location and therefore breaking the rules. Northern Ireland is part of the UK (I’m not being political, it’s a fact when it comes to listing your address).
This person (I’m guessing it was the big competitor or maybe someone who disliked me) kept complaining to ebay, ebay kept removing my items, I would complain to ebay and two weeks later they would send me an apology and I would relist and then within a week it happened again. Even though ebay removed all the violations from my history and admitted they were wrong, they didn’t stop it happening. There was at least two weeks out of each month I couldn’t sell as I was waiting for ebay to make a decision (if I’d relisted and got removed again there was a good chance of being suspended as I having so many items removed at once). The hassle was huge and no way to run a business only selling two weeks a month. No amount of complaining, asking to speak to managers, getting reassurance their staff would be trained to know Northern Ireland was part of the UK, a note put on my account to make sure my items weren’t removed for this bogus reason would make it stop. I gave up in the end. Luckily I only was using ebay as a stepping stone.
I always assumed it was the big competitor targeting me but could never prove it. I did a little experiment and reported them (for a genuine rule break) on a few occasions and nothing ever got removed. I always wanted to know do ebay turn a blind eye to the people who generate them £1000’s each month. Just a thought.
I learnt you either play by the rules and how ebay works or just leave it.
