As I said before - the level of service, hours of opening, availability of products maybe but price???
    ...
Is there so much demand for carvery on Sundays that Toby charge more for the same food and can get away with it? What other restaurant does this?

I thought it was fairly common to have special menus and different prices on Sundays.
At least one of out locals has different pricing for Sundays and it's not a Toby.

Not really relevant but that pub is the last carvery I went to (about 2 years ago). I remember it was quite good, although I preferred going to the hare and hounds when it wasn't a carvery

This is the problem with trying to work with what people 'think' and what 'everybody knows' and what they perceive to be 'common knowledge'.

It's also why we have a language with well understood meanings.

If a sign says: "Mondays to Saturdays £xxx" without qualification, then that is precisely what we are entitled to take it to mean. We see that and all we need to know is: 'is it Monday to Friday'? Not things that are not even mentioned such as whether it's a bank holiday, there is an 'r' in the month or a Luna eclipse is due. If the company in question want to have certain exceptions they are 100% free to state those exceptions. The law will not side with them if, despite having complete and total control over what the sign says they choose to omit some qualification they would like to make.

The whole basis of the law is to attempt to make things clear so there is no reliance on 'folk knowledge' or 'common knowledge' which may not be nearly as common as those hold it believe.

Have you deleted a post? I'm sure when I left work at 5pm you had written a rant about me? The phrase post 79 rings a bell. I was just about to respond but it's gone?

    Yes.

    You were quite right.

Life's too short for silly squabbles. :)

If I don't reference the sign specifically when ordering, how do I know I'm not ordering something similar to what is on the sign but which has a different price?

"Mondays to Saturdays £xxx" is not precise, it is vague

Does it mean I can take 6 days to eat my meal?

Do I get 6 meals, one per day for that price?

Can I turn up at 1am on a Monday and expect to be served?

It would be up to the waiter to ascertain that. It's his responsibility to determine what you are ordering and explain if there is any variation from the clearly advertised price.

I fear you are just being daft, now.

The sign is unambiguous about what the sign purports to be about.

It has nothing to say on the matter of opening hours so you are not entitled to make any assumption about those on the basis of the sign.

What the sign is 100% clear about is that the price for the specified meal is £5.95 from Monday to Saturday. And you are therefore absolutely entitled to take that to mean exactly what it says.

It is the responsibility of the restaurant to make certain that you are aware of any variation not mentioned along with the initial invitation to treat.

In the people that object to you defence. Trading Standards have only said they will investigate. There is no guarantee that they will find in your favour.
sorry to nit pick, but they actually said they would pass it to their investigating team..

It would be interesting to see what they come back with.
    Agreed

I'm not sure when Voltaire wrote that he forsaw it would be used in an argument over a £4 price increase at a Toby Carvery
    no probably not :)

TS do not investigate unless there would be, on the evidence presented to them, a case to answer.

Nice try. Voltaire didn't write that. Better luck next time. Not that it makes any difference because the use of old aphorisms is not dependant on their authors foreseeing how they will be used.
No my bad, although in defense it was also in dispute but I understand consensus swayed to EBH?

Blimey what a load of twaddle !

Not saying any of it is wrong but does anyone else think it's all gone a bit OTT ?

If you order food from a menu, surely you accept the price on that menu ? Whatever day it happens to be ?

My local carvery is more expensive on a Sunday. Personally, it doesn't bother me what they charge on what day as long as i'm happy to pay it. If i'm not, then i don't go. But it still beats cooking sometimes :)

There are clearly displayed Sunday & Bank Holiday menus on display in all premises, plus the website as someone has previously talked about also indicates this.

There is a feedback form via the Toby website that you can submit feedback to regarding this. Expect to wait around 10 working days for this to be dealt with as I understand it is processed via their head office team before the complaints are fed out to the Toby in question to deal with: http://www.guestfeedback.co.uk/nationalsearch/tobycarvery/
