    Three carry on ignoring my concerns and individual circumstances with insulting templates via e-mail correspondence. The only reason why they bothered to reply was because I had the tracking numbers they sent me after receiving my e-mails.

    They are now no longer issuing automated issuing tracking numbers. I wonder why?

    Their repugnant attitude only enforces my decsion that I was right to cancel my contract and take them head on.

    Experian DO NOT have a "score" on file for you. They (and other credit scoring agencies) record when you make a payment, if it's on time and if not it's late how late it was. They will also record any defaults and CCJ's against you. Any credit score number Experian give you is based on their interpretation of your record.

    Any other company who wishes to credit score you will ask for your payment record and score you on their own internal procedure, they do not simply ask for a numerical score. Different compnaies have different criteria as to whats acceptable to them depending on the sort of customer they want.

    Which and Three cannot do anything to change the score any another company gives you, your payment history is a matter or record, either you made the payment on time or not, nothing more.

    If you don't pay on time it's get recorded and this will influence your score but thats down to you not anyone else.

    And when Three unjustly place a default on your credit rating due to cancelling a contract? How does one appeal?

    Same way you appeal any unjust reason, you appeal to the person who put it or take it to a ombudsman.

    Depends why it's unjust, if it's because you don't want to pay charges that are due thats not a reason, charges should be paid under protest not left unpaid.



    I've left and joined Three a few times over the years, never paid any termination fee's and never had anything put on my record.

    I don't know all the details of your case (ie why you cancelled) but if you cancelled a contract and were asked to pay a £350 termination fee, as you seem to have ignored it (regardless of if it's right or wrong) then there is a case for the default to be put on your credit record. You should have put the amount into dispute in writing not saying "3 can do one. " If as you say they still put a default on your file you need to take it up with a soliciter and court and if the case is decided in your favour the default will be removed.

    They are ignoring my questions and answering with templates. They can "do one" because they are a shambolic disgrace, not because I am ignoring them. On the contrary.

    My final invoice from three arrived today.
    listed on it was a final termination fee (£684), despite my citation of 10.1 and clear reasons why I was legally able to cancel without attracting a cancellation fee.
    I will be visiting the citizens advice bureau tomorrow.
    I have a couple of things I was thinking may be a possibility. I send the invoice back to them with a letter explaining that they have made an error in the invoice and it needs to be rectified before I can pay them anything. another option is to talk to a solicitor and pursue any potential to sue three due to current or future action by them. for example, if they place a default on my credit file, I could sue them for defamation or something like that.
    I'll see what the CAB says.

    Ok,
    I finally got to the CAB.
    he read over it all and he pretty much agreed with me. of course.
    but when he spoke to his supervisor he said she didn't agree.
    it wasn't that we are wrong in our interpretation, it is more like that supervisor had seen a lot of these kinds of thing and noticed it to be very difficult to challenge in the past. the advisor who was helping me said he didn't agree with her, but this shows a disparity.
    well aside from that, he advised me on actions to take.
    he said i could just ignore them and they would sell their perceived debt, and the debt collector wouldn't care about the circumstances and I would be left with one option, to get a lawyer and challenge it in court. costly and stressful.
    other option is to contact my local trading standards office and get advice, whilst at the same time sending the invoice back to them along with my original letter asking them to explain.

    the draft he gave me for the letter is as following:-
    Dear Sir,
    I refer to my letter dated 21/6/12 (copy attached) Which was acknowledged by Email but to which I have not received a response.
    I also refer to invoice for period up to 10/07/12 in the sum of £695.27p.
    I look forward to receiving a response by return.
