It's a shame as I didn't mind 3 but I'm sick of being mugged off in this country and refuse to take it any more. And I know what will happen, I will cancel my contract based on 10.1(d) they will ignore it, still demand money owed, then send the 'debt' to a collection agency thus resulting in a detrimental credit rating. Such is Britain.0

right, i'm sick of this now. i just got a text saying my iphone contract will go up by £1.25! i'm going to send a letter to Three notifying them that i don't consent to these price increases and unless they credit my account with whatever the increase is i'm cancelling my direct debits and going to court for breach of contract.
can anyone give me some ideas as to what i can use in my letter? i'm going to quote the Ts&Cs mentioned in the last few pages for sure, but other than that i'm not too certain what else i can say.In case you were wondering, my username is in reference to Transformers the Movie.0 -
Rang them again, they refused to concede, stated I would have to pay the cancellation fee (13 months) and would not be issued with a PAC code until the whole fee was paid. The agent even conceded I was right but said her "hands were tied" So sick of this.0

I believe the flow chart posted somewhere above is very useful to include with the letter. also, a full copy of the agreement.
my agreement does not include a definition of material detriment. therefore it is ambiguous and automatically favours the party that did not draft it. me. even the standard definition of detriment includes anything of monetary value. 3.6% is of detriment to me. that is a fact.
I'm just so frustrated at how they have treated us, that i do not want to continue dealing with them. previously i would have been happy for them to conceded that they have done me wrong and reverse the decision to change the price or some other placation. now I am just ready to wipe my hands of them.
I may not be a lawyer but i know what it says in my contract and I understand what it means. it's quite clear that i have a right to cancel without a cancellation fee if they vary the agreement in a way that is detrimental to me.
the question is, if they decide to invoice me a cancellation fee, who would i go to to challenge a false charge? trading standards? ombudsmen? a lawyer? citizen's advice bureau?This is a system account and does not represent a real person. additionally, something i need to point out.
talking to customer service today, the lady kept trying to take me back to a specific point, the 16th of july. she kept saying that after the 16th of july 10.1 would come into effect and if the change proved to be detrimental, i can cancel without fee. rather dastardly thing to do since 4.3 states clearly that if i continue to use the service when the change comes into effect, I will have deemed to have accepted it. and also we only have a month after the notification to cancel without fee.
also, I kept trying to make it absolutely clear that 10.1 was already in effect as they have already notified me of a change.
secondly, I want to point out that they are required to notify us a month in advance if they 1)discontinue the package 2)make any variations that are likely to be of detriment to me 3)increase the fixed periodic charge more than the RPI...
now, if three were making this increase in a fashion that did not apply to these 3 points, they would not have had to inform us more than a month in advance. they have definitely told us more than a month in advance which seems to kinda suggest the change applies to one of these points.
it seems to me that they are just throwing all this crap at us to try and psyche us out. my guess is, if we simply cancel, they will not dare to raise a charge against us.This is a system account and does not represent a real person. I'm still going round in circles getting the same standard response to every email that doesn't even answer the questions asked. I don't really want to phone 3 because I suspect my patience will run out before theirs does and I'll just waste an hour arguing with someone reading off a script.
Just annoying that it takes them 3 days to reply to my email and it turns out to be identical (word for word) to the previous reply.
Does anyone have any suggestions on how to speak to someone at 3 that has the authority to have a proper conversation (ie not trying to match my question to the nearest stock answer)?0 -
no, it's impossible zkw29. three fails to realise their terms an conditions differ from orange's and the others. they emphatically don't have the right to raise their prices without letting us get out of the contract, it's that simple.In case you were wondering, my username is in reference to Transformers the Movie.0

I'm surprised they would do this to existing customers for such a small increase, and surprised that they can.
I'd told my fiancee to get an S3 on The One Plan as her contract with another provider has run out, but she will be looking elsewhere now and so will I as soon as my contract runs out.
