    My mistake. Only 1 month sim only deals escape the increase.
    If you joined Three on or after 8 March 2012, or you're on a 1-month SIM Only, Business or Pay As You Go plan, this price increase won't affect you.

    Hi Guys and Gals
    A lot of chit chat here but has anyone here actually successfully argused "detrimental effect" with Three on current price increase and terminate the contract early without penalty charge? Success stories please!

    The reason there isnt any is because you cant terminate the contract under that clause.

    I emailed 3 Network this week regarding RPI of 3.6%, two telephone conversations with 1) Customer advisor 2) Manager, they will not provide email or letter stating i cannot leave contract or continue on current payment terms, unless i pay upfront termination costs for remaining time on contract (December 2012) or pay £10.00 for full notes on my account under Data Protection Act, to confirm i did not financially suffer from a 'Material Detriment' on two monthly contracts. I stated i will take further & hand in notice near end of contract. I am so annoyed!
  • Hello all, Long time lurker first time poster like others here i face a price rise on my 3 mobile contract.

    Everybody is quite rightly angered/upset by what should be a fixed
    contract,like others here i was given verbal assurance of the same.

    Many are saying they will vote with there feet and ditch 3 at the end of the contract and i may do the same but this is not an answer as people are joining/leaving all the time and you still have to pay up for the duration of your contract be it 1 month or 12.

    Others are quoting chapter and verse from the contract clause this paragraph the other etc but i am not clever enough to understand that and dont actually know anyone that reads them.

    To 3 this seems to be a storm in a teacup which they are hoping will
    quickly go away which it probably will,there will no doubt be some angry letters/e mails but overall it will amount to nought and any loss to 3 will be minimal.

    I am fed up with autonomas grey suits hiding behind faceless conglomorites and foreign call centres (Jake MM,S post above is a classic, are they even speaking the same language ?)

    They will get away with this unless we stop them, how?

    Easy, as many bodies as possible congragate outside any 3 mobile shop or even head office to actually show them how we feel.

    This is much more effective than bashing the keyboard as the worst
    publicity is bad publicity.

    So how about it ? pick a day bring a placard and some sandwiches
    make a day out of it i am guessing central london for maximum exposure 12 bodies would be a good start 24 and they would really notice any more and we are rocking, do something or nothing will happen.....

    3 mobile have clearly mis-sold contracts if they think they can enforce this. They have never disclosed this term they are relying upon in any sales pitch.

    It's not clear what "this term" is you refer to.

    If you mean the price rise being permitted then yes it's in the Terms and Condidions you agree to when you take out a contract, be it on the back of the contract you sign, by the telesales person asking if you agree or you ticking the agree box on the web order form.

    You *MUST* have agreed to them to take out the contract, did you read them before is a different question.
    No-one was co-erced to sign the contracts, the simple fact is many of us just skim read them or click the button without reading them, and in that case you can't then comback to argue with something you agreed to without reading.


    One of the conditions is a price rise is permitted as long as it's not above inflation, the rise isn't and so it's permitted.You may not like it but that doens;t make it illegal, just annoying.

    As has been mentioned here, T-Mobile, Orange and Vodafone have all done it already, and many people have said they will challenge it. The ombudsman have looked into it and decided it's a comercial decision and so will not do anything, why would this be different.

    So ppl - i am no lawyer, however based on what their Ts & Cs say i think we are well within our right to cancel and not have to pay for the remainder of the contract - plus entitled to keep the phone i think as it does not state they want the handsets back at any point.

    What are your views re this?

    I have called 3 and raised this matter, after speaking to customer services i have realised they are only citing point 4.1 of the T&Cs which states they can increase the price plan - they are not fully aware of the rest of their terms which i cant say i blame them but surely they shoudl have been told to look out for customers relying on the point 10 clause???

    I have asked for a manager to call me back and see what happens but i really dont see how they will work around this.
    The adviser i got sai due to the fact the increase is not above RRP clause 10 will not come into force, however that should be specified in either clause 4 or 10 or any other clause yet it isn't so went round in circles - let's see what the lovely manage will have to say lol but i'm gna stick to my guns and see what happens.:T

    Would love to get out of contract early even tho i only have 4 more months to go, however if i get to keep the phone i can get a sim only and save about £92 by cancelling (have £35pcm contract and sim only is at £12pcm)!!:D:money:

    Read the whole thread. What you have suggested has been tried (and failed) before because the price rise is at the rate they state is allowed in the t&c therefor is not at your detriment.

    I'm 7 months into a £30 a month iPhone contract with 3. I've just had the email saying they are putting my bill up to £31.07 a month. I would like to get out of it if I can. Not happy that they are just raising prices willy nilly and trying to pass it off as a false positive about it being the first time blah blah blah...

    I didn't even get my iPhone free, I had to pay towards it.

    Thank u for that because i did just read abvout 2 pages lol and then post a reply so sorry folks again for this argument as it has been bashed now for a while!!

    Agree with those that want to fight this out - will defo be writing to them and taking this further. Even if i get the increase written off i will consider it a small victory.

    3 are just to***rs!!!:mad:
