Scan the letter email it to Experian and spell it out to them change it as under data protection law the information is incorrect and therefore in breach of the data protection act. They can instantly update. do not accept 28 days.....And you feel this matter is causing you stress and therefore you will be informing OFT and trading standards and who ever will listen, also you will now be seeking legal advice.
ps. send the letter from natwest to watchdog too.
I would seriously email them and phone them directly saying they have failed to give you a manager call back within 24 hrs and you want to speak to a manager now before you initiate legal proceedings againts them. Also copy all posts on here from the experian rep. as you might want to use it as dissassociation is not acceptable you want it removed. Bottomline, Experian is getting paid by finanical institution to supply data on people and therefore have to ensure data is accurate, when informed with evidence that the data held is incorrect they MUST CORRECT IT. Prolonging the removal does induce stress on the person the data is held on. Also you could be lossing money in regards re-mortaging more stress. this all adds upto a claim directly against EXPERIAN as it is there responsibility to ensure the data is correct. P.S. Copied the pastes on here by experian just incase they now delete them0 -

Yep go direct to the source, well done ! James Jones @ Experian care to explain yourself here, Equifax has done the right thing, why are you (Experian) making life difficult for this person? This is not an isolated case, I have had problems with your company as well!
He won't be back. He only comes online to tell us how much value for money paying £14.99 a month for a made up number and a report you can get for £2 is.
Sooner people realise they're not here to help anyone, but extract as much cash out of vulnerable people, the better!0 -

I've had a similar situation that went on for 5 years, where someone with a similar name and same date of birth was in debt and all her crap was on my credit report and her addresses that I never lived at.. it took many letters and many dealings with the CRA 's to get this sorted, all seems to have stopped now although I've probably spoken too soon....
Demand to have a case manager at the CRA as if you have your identity stolen, you get your own case manager, so I told them as I was a case of mistaken identity ( as are you) then I should have my own case manager too. As I was speaking to one point of contact at Experian/Equifax and Callcredit it meant it got sorted out quickly, please PM me if you'd like my contacts at the CRA's as they were very helpful, James Jones commented on my situation on here and was shot down in flames, he doesn't actually say anything of any help, just standard company blurb.'' Well I was looking for a email address other than the general customer service one, and I found one listed for a director of communications, although I called him first and he advised I contact James Jones and Lucy Davies, gave me all thier email address and email him too, so I have sent it all again with the emails I have recieved from Natwest, I hold no hope whatsoever but I do not know what else to do here, I am in tears the stress this is causing me, there is just no way to describe it, thank you all here for your support0

Excellent post, I also wrote to the OFT, Information Commisioner and Watchdog, and after kicking up such a stink as my credit reports were ruined ( had a CCJ on there and 30 defaults at one point that didn't belong to me) I got the data removed immediately, making you wait 28 days is unacceptable when it's not your problem...'' It's disgusting that wrong information is allowed to be reported like that. It is OBVIOUS it's two completely different names, yet the CRA's allow this to go on because it makes them more money when people are forced to pay to access their OWN information.

Guys seriously, Data protection act states "all" data must be accurate. The key word here is "all" if one initial is wrong or one digit out on a DOB . A single mis-spelling of an address. It has to be removed or ammended based on the original credit agreement etc. They cannot just ammed it to your initial etc. Therefore, THEY HAVE TO BY LAW REMOVE IT as it is NOT accurate.
So basically if you notify them they have to remove the post or provide you with the data that actually PROVES it is you.
If they cannot prove it is you they do have to remove it...no arguement there. if its wrong its worng....simple and data protection act states that!
This line they give you "we will check with the OC" is utter BS. The data is wrong you remove it NOW or I will initiate legal action TODAY. You have the proof move it now. NOT negotiating with you. you have the proof sort it out!
Holding incorrect data is a crime end of conversation with them! also point out Equifax have sorted it out instantly as it was incorrect data....if they continue saying blah blah say to them simply so you are actively breaking data protection law? and then inform them you are recording the conversation (I would record it from the off).
You are in the right. So don't get stressed make them STRESS! put the boot on the other foot.0
