    i've just got back my letter from the FOS agreeing that my appeal against HFC had been won and sold unfairly

    but i originally was going through HYC but again as most posters have put have done nothing towards this

    being promised a monthly call to show progress and myself having to phone them continually over the three years it took for the case to come to a close i eventually phoned the FOS myself to see the situation of the case and they informed me that they had sent letters to them to be forwarded to me which had never happened?

    and from this discovery FOS then just went through myself

    where do i stand by not saying anything to the HYC and carrying on as normal? see as they have done nothing towards the claim either way?

    You need to check your contract with them. They are normally pretty watertight and require you to pay a large proportion of any redress won as a result of any complaint they make on your behalf. It's legally binding, I'm afraid, and they will set debt collectors on you if you refuse to pay. Again, check the contract.

    They will doubtless be presenting you with a bill of their "services" shortly.

  • We have had a longstanding claim for PPI on a loan which was taken on as a test case. It has taken 9 years!! We claimed within the 6 year window in 2004/5 and went through a well known company for its handling. After a long period, they decided it was not viable and returned our admin fee but we plodded on with FOS. Unfortunately we do not have the original paperwork and we settled the loan in 2005 in full and were charged a massive sum and there was no breakdown of how it was compiled. We do have this paperwork. We are OAP's and are concerned that when they settle we will not get the right amount due to us. Should we apply to the loan company for an SAR or will that get their backs up as they are settling due to a moral obligation rather than the legal side. There were 1000 other test cases such as ours and ours was one of the first to be decided due to length of time we had been waiting. I have tried to get back copies of our bank statements but unfortunately they don't go back further than 6 years and we never thought to keep them. Obviously whatever refund we get comes direct to us rather than having to pay any fees to the original company we went through to make the claim but we are concerned that we will be taken advantage of. Any advise would be appreciated.

    The PPI redress shuld be the original amount of PPI charged plus assoiaed interest, lus 8% simple interst. If ou don't know what the original amount was and the interest, you can send a SAR but they may no longer have this info.
    Send one and see, if they don't have the info, they can probably resructure it from your bank statements, which you are more likely to be able to get with a SAR.

  • I have considered PPI on some old student accounts and etc only thing is I can only find one account number ???

    and I know the address of the bank from 1998

    I went into alot of debt and was unemployed etc so I need advice on if this one account number is enough and can it be linked to the credit card I had. I have thought that my current account will have payments onto them when I was paying back the debt, but was like 2000 etc doubt my bank will keep records that far back?

    any help would be great have just though of going to a PPI claim co but Martin mentioned that they only really want the easy win cases??

    Hi all


    I just had to post this as I simply couldn't believe it happened to me!


    My mobile went off earlier this morning in the office from a number I didn't recognise. 01942 710603 was the offending number but I digress.


    An extremely chirpy woman with a Liverpool accent then informs me that she's phoning from Money Saving Expert where I'd used one of their switching tools.


    Now, I'm fairly certain that MSE wouldn't sell my details, and I have no trouble believing that the switching service would, but I just had to let someone know on here that there is a call centre farming out to annoy people into letting them handle PPI reclaims for them by claiming to be associated with the internet behemoth that is Money Saving Expert!

    I am doing the same and with good results, especially when we only knew we had it on the mortgage and now find out it was on a lot more.
    Now I am helping my friends reclaim.

    I got contacted by RBS and By Marks and Spencer's to ask further questions, the last call was just last Monday!

    i had letter back from Capital One and from RBS, the credit card ones, both letters said they didnt agree with my complaint etc, sending me the copy of the application form that i filled in.

    ok, fine, i will let those go as they wont be much money anyways.

    On 1st November (our wedding Anniversary :-)) i received a letter from M & S saying that they were upholding my complaint and offered me £4858.88 which was based on the mis selling on 2 loans.

    My god, what a shock to see that, really really good news.

    TODAY!!!

    I received a letter from ROYAL BANK OF SCOTLAND sorry 3 letters, here is what i got

    Letter 1 - £3354.27 , wow really good again!
    letter 2 - £4191.39, my heart starts getting faster!!
    Letter 3 - £5577.02 now i am really trembling!!!

    In total just shy of £18000!!!!

    They asked me how i felt about my complaint, and i said the worst thing was not knowing how much extra i was paying for something i would never have needed.

    I have never been unemployed and have always had work based sickness plans.

    My point is - if you don't try to claim then you will receive nothing at all. It probably took me a couple of hours worth of researching who to send to etc. use this website and get your fingers out. For the cost of a couple of stamps??? Get on to it!!

    Now i just need to wait for the money!!!! I think i may even take the wife on a honeymoon that we never actually had!!!!:D
