In fact if I do pay them I will actually be rewarding them for not doing anything, if fact it is in their interest to do nothing. Any ideas of a way forward??
Unfortunately, although the Bank have corrected their error without any input from the Claims Company, the fact remains that the revised amount is STILL redress awarded in respect of a PPI complaint.

You'll probably have to pay up in accordance with the legally binding contract you signed with them I'm afraid. You need to read this contract very carefully
The problem is that too many people who use Claims Companies think that they actually do a lot of "work" on their behalf. Basically, all they do in reality is put a stamp on the complaint and send it to the bank. They have no special influence and cannot force the Bank to act any differently than someone acting alone.

This is just one more reason why no one here will ever recommend using a CMC. A total waste of your money, they do nothing you could not do alone.
  • Dear Moneyineptitude
Many thanks for your advice, I decided that I better pay them, then I received a letter today which was a response to my issues outlined earlier and they state that the PPi had not been cancelled and that according to their Terms and Conditions Clause 4(i) it was my responsibility to cancel the PPI, however it appears they have misinterpreted the clause as it states The Client will “Acknowledge (s) that if the claim was successful for compensation for a PPI policy, the policy will be cancelled and that they are responsible for identifying a replacement policy if appropriate”. This makes the assumption that the policy would be automatically cancelled and it was only my responsibility to ensure I made provision in the form of a new PPI policy etc. Additionally the new letter has mis-recalculated their fee which now stands at approximately 54%. Every time I get something from them it changes.

This is nonsense. Report them to their regulator; the Ministry Of Justice.

We have 2 claims with the ombudsman against Pinacle (GE Money)(Loans.co.uk) for miss selling PPi.
Its now been 22 months not heard a peep... decided in the beginning to forget about it as knew it would take a long time.We were told 18 months in the beginning now on ombudsman website they are stating 2 years so though I would give them a ring both claims are still waiting to be looked at , were told we are probably looking at 2yrs or more wait.

This will be because they are looking at the tiny possibility that pinnacle have liability even though they didnt sell it. It only happens in a small number of cases as normally the seller is liable. So, your complaint against Pinnacle is unusual and unconventional and will take longer.

I assume the claims company you are paying has explained this to you (this thread being about claims companies)

  • Hi

I am new to this forum and not entirely sure if this is the correct place to post a couple of questions but here goes.

I was contacted some time ago by a claims company who wanted to let me know I was due to compensation for mis-sold PPI on a loan I had taken with Black Horse. First question:- How do these claims companies get details of loans I have had and how do they know how much I am due to in compensation?

Having been given the information I decided to try and make a claim in my own right not wanting to give 30% of any compensation money to a claims company. I have, therefore, written to Black Horse on two separate occasions only to receive the same standard letter both times telling me that because I am unable to provide them with an agreement number that they are unable to take my claim any further.

After reading the steps to take on Martin's web site I once again wrote and asked for the name and address of their underwriter so that I could contact them personally and try to find our further information regards an agreement number. I wrote about three weeks ago and as of today have received no response.

Any advice as to what I may do next?

    Thank you

They don't know anything. They just want you to sign as their customer and charge 30% of any redress should it be awarded. They just guess at Banks and loan amounts and hope to strike it lucky.

Are you sure you had loans with this lender? What about PPI? You are not simply acting on the "information" given to you by the claims company?
If you are sure, send the Bank a Subject Access Request (SAR) letter which should return any records the Bank has kept about such finance in the last six years. It will cost you £10.

Contacting the underwriter in your circumstance is futile.
Again, contact the Bank with a SAR letter and see what they come back with. If the SAR returns nothing useful, then your "complaint" has ended before it's begun.
  • First post. If this question already asked I do apologise.
I complained to Barclays re PPI. They didn't agree. I contacted the Ombudsman who sided wirh Barclays. I appealed and provided further information. Today received a letter from Ombudsman stating they have changed their assessment and now find in my favour.

They have written to Barclays. However, this isn't a final decision. Barclays likely to counter appeal? Not quite sure to be happy or cautious.

It can still go on for some time, but you've won the battle if not yet the war..
