I don't think anybody really thinks they will get the ring but in my opinon I would like them to take responsibilty for taking money out of my account when they had no intention of sending the item, so maybe some sort of goodwill gesture perhaps. Anyway sent them an e-mail saying OFT advised to send them a letter quoting statement from kathyb1230 post (thanks kathyb1230). So I have put one in post and will expect a response within seven working days. Their reply below came just now.

Thanks for your e-mail about the order.
Please accept our apologies for the inconvenience and we will await
your
letter.

I also sent them a letter telling that i'd been advised by Consumer Direct that as soon as they took the money out of my bank (Friday afternoon) then they'd formed a legally binding contract.
They've just emailed back saying:Your comments have been duly noted and if you wish to pursue the matter
further please write to our legal team at the following address:-

I've had a reply from Littlewoods today, saying
"We emailed you on 5/3 to advise you of the error and to cancel your order. This action was consistent with our terms and conditions, which clearly state that we only accept an order when we dispatch the goods.......I would explain that there are 3 essential elements for a contract to come into effect; offer, accetance and consideration (payment) and in this case, there was no acceptance."
Am too tired to think straight at the moment, so what do you all think? Is this the end of it, or does the fact that I had an email confirmation and payment was taken mean I could try to take this further?
I'm assuming not, but a goodwill gesture from Littlewoods would be nice, seeing as they kept my money for 5 working days before refunding.Lead me not into temptation - I can find it perfectly well all by myself

Sounds to me that they are worried...They will not offer any kind of goodwill in case people see that as some kind of admission and persue it further.
3 elements :- Offer...was there for all to see.
Consideration....money was taken from account.
Accceptance.....I have an e-mail with the title 'order confirmed' and expected delivery date.
This to me is the three essential elements that they mention below therefore clarifying that the contract had been made. Will be returning a letter stating such (including one to there legal dept. at the address stated in 'alanalea post) and would suggest other people do the same. Would be happy to let it go but Additions are now annoying me by not even admitting they were in the wrong to take money.0 -
