RSPCA are a pet hate (excuse the pun!) after one of their door to door salesmen accosted my Mum a couple of years ago. She's in her 70's and can ill afford to donate more money than she already does. The man got quite nasty with her, as he marched down the front path he shouted "So, the woman that lives here condones animal cruelty then!"

I was understandably livid, though I felt somewhat better about it when I heard from the RSPCA a week later that he was 'no longer employed by them'.

    An interesting point.

If someone sends or delivers something to you accidentally then they are entitled to collect it within (IIRC) six months, at your convenience.

But if you have a sign that explicitly states that any unsolicited material will be disposed of, I would imagine you are in the clear as they will have deliberately presented you with whatever it is knowing that you intend to dispose of it.

The interesting case is where you simply say "No unsolicited catalogues". Whilst it's never likely to come to court I'd be interested to know the legal technicalities in that case.
Well, for a start they would have to prove that they did post it...

Claimant: M'Lud I posted a catalogue through their letterbox and now I'd like it back.
Householder: I never saw it M'Lud, and I put up a sign saying please don't post catalogues through my letterbox, so I assume they must be mistaken as there would be no point in them doing so. However, if they wish to do it in the future I would be more than happy to charge them a fee for its safekeeping until they are able to collect it.

    A Red Cross bloke

He said I know you have a sign but...

My husband closed the door on him

    Johovah's Witness's ignore it too

I won't answer the door unless I am expecting someone or my husband answers it.

Yes, both myself and Pulliptears (For years now I've read that as 'Pupiltears' - only on checking to type it did I realise I've been misreading it." have already made the point that no such case is likely to get to court.

When you are considering civil legal hypotheticals you assume that everyone tells the truth since it's the minutia of the law that interests you.

We weren't seriously bothered about the risk of throwing away an Avon catalogue. :rotfl:
There are two types of people in the world: Those that can extrapolate information.
  • Everest, even though i was on the phone at the time and told them i wasn't interested they were still trying to sell as i was shutting the door on them
  • As an Independent Kleeneze Distributor with a large team of distributors myself I would like to add the following to this discussion. Kleeneze is approved by the Office of Fair Trading. They have stated that No Cold Calling areas and signs do not apply as we are not entering selling or buying transactions on the door step. 90% of our customers do indeed have these signs but are happily ordering products on a regular basis so it is confusing for both new distributors and householders alike. As distributors come and go it is not guaranteed that you will not get a catalogue posted through your door by simply telling the distributor as there are no territory restrictions and the next distributor would not know this information. I advise all my distributors to post a catalogue through unless there is a sign on the door that says No Catalogues. Kleeneze distributors pay for their catalogues, are often people working hard to make ends meet and save money rather than relying on benefits and I have 600 customers in my own local area alone that value the free door to door delivery service from an 88yr old British company. Please put a sign requesting No Catalogues on your door if you really don't want any, don't bin them it is hurting hardworking people financially and damaging the environment, we reuse them. If someone ignores a No Catalogues sign then go ahead and recylcle. Thank you everyone :)

Thankfully I dont get bothered other than by Jehovah's Witnesses and I never let them into the flats anyway.

My mum has a sign saying no junk and no door to door salesmen and for the most part they leave her alone. Safestyle Windows ignore that sign and immediately say "we're not selling anything" and then they harped on about her double glazing and saying that she should have new glazing as her current windows are about 6 years old. It took her 20 minutes to get rid of him and in the end she was quite rude and told him to Foxtrot Oscar off. I know that her sister gets plagued with phone calls from Safestyle after she asked them for a quote but in the end she placed an order with another window company.

I think it is quite disgusting that Safestyle prey on elderly ladies - No meeans No.

Some solar panel company, told them to jog. Mind you they did ask if my parents were home. I'm 25 with a mortgage!!!!

Me too. I pointed out that we already have solar panels (can be seen from our driveway) and thermal panels. They asked about my parents - I'm 38! I guess I should be flattered.
