I don't think it's quite fair to say that people don't educate themselves about renting - when they enter the rental market most people (wrongly) assume that it's well regulated and that they'll be treated reasonably well as a customer and that they'll have some redress if things go wrong. The reality is that as a tenant you can be in a very vulnerable position, particularly if you're on a limited budget. You've generally got a limited amount of time to find a property, and it's very rare that you're in a situation where you have a lot of choice - most people need to stay in a certain area or need certain things (parking, a shower, a downstairs loo, x number of bedrooms, a LLwho'll take a pet for example) which mean that a lot of rentals have to be discounted. Although people say 'shop around and don't use agents if you're not happy' if they're the only place that have got a property that takes a pet then you're stuck. When things go wrong there's often little you can do - a few years ago I reported an LA to the Property Ombusdman. Without going into details they'd behaved appalingly, lied, cost us a lot of money and put my partner and I in a position that (no exaggeration) could have killed us. The Ombudsman agreed with our complaints but the only result was an offer of £100 compensation - not much of a slap on the wrist for the LA.

I've been renting a few years and I've learnt an awful lot, but I'm constantly surprised at how little most ordinary people know about the rental market. They don't understand the fees you pay, they don't understand how LLs can get away with renting out filthy properties, they don't understand about inspections, or how LLs can get away with not doing repairs. As a tenant you are often 'trapped' in a contract, and you often have to balance the cost of moving again with the problems in a property. Equally, when you're going into a rental you're often in a position where you have no choice but to pay the fees - if you're a week or so away from having nowhere to live then you pay up, regardless. It does scare me how every move is a leap into the unknown, and how powerless you are as a tenant.
I know a lot of people on this forum have had problems with tenancies and trying to get into property but there is another group of people like myself who have been ripped off for thousands of pounds by HTG\TDC\Bentley\Kiely by doing work for which they do not get paid. I am owed £1,489 and a colleague is owed £532 for work carried out at just one property so how much does this expand to over the whole property empire? After Brendan Kiely put out his very generous offer of paying up any unpaid bills that may of slipped through the net due to incompetant staff on Watchdog I resubmitted my unpaid account to Middleton and very soon had a telephone call from Brendan Kiely (18\4\12) who promised to check up and send me what I was owed He did remember the property as he had his own issues with the people who had purchased the property from him. Brendan Kiely said he would call me back but had not done so by 20\4\12 so I called him on his new office number and spoke to a member of staff who told me he was away for the wekend I called again on 23\4\12 and was told he was then in a meeting and would call me back, by now I was having memories of November and December 2011 when I seemed to hear the same thing quite regularly, anyway to date I have had no telephone call and worse than that no cheque. Maybe the cheque is somewhere in the post or maybe the postage is now so expensive Mr Kiely has to save up for stamps
    Im still waiting

  • Yet again, people seem to be very good at looking out the window to blame all and sundry for their own shortcomings, it never ceases to amaze me... take responsibility for where you are in life, if it's not where you want to be and you want to blame someone, then look in the mirror. Stop being so judgemental, after all reality is just an illusion and so is ones perception of what is right and wrong........ We don't need more legislation are we not being controlled enough? We think our own thoughts, all action is preceeded by thoughts so think happy thoughts and live a happy life!! simples!! get on with it you neg heads and stop criticising, condemning, complaining just to mask your unhappiness

1 post, and the wording style (fairly non grammatical and nonsensical) similiar to other posts under different names lol. He must like having his name appear in google.

I do hope that these posts continue (in spite of their yawn making repetitveness). Not only does it make sure Kieley and his company maintain an easy view google position.., (enabling some 'warning off' factor).., it allows a view of his personality.

Had a letter from Kiely empire regarding non payment of my account
Now this is good, because the homeowners have not paid the retention fee, probably because it will cost them a considerable amount more than the money they are holding on to to allow them to finish off their home to the standards promised , this has caused a cash flow crisis for Mr K. Therefore my workmanship and input has been deemed as substandard. Maybe I also put substandard electric into the electric meter from a sub standard sub station maybe and substandard gas into the gas meter and the certificate from a suitably qualified electrician was also on substandard paper or some other rather feeble excuse. Just because you don,t get paid for a job it does not give you the right to make others pay for your mistakes. If my sub contractors do a job for me, I pay them, whether or not I get paid myself, this is called fairplay to some people. I do not ever expect to see the colour of Mr K,s money because obviously he needs it more than I do. Wealth cannot create happiness if you keep it to yourself Keep my money Mr K and enjoy a happy life with it.

  • Squatters rights With the recent change of law regarding squatters rights I wonder if any of HTrad\Bent\BK properties have any problem with squatters ? Probably not because the squatters have got higher standards than any of the sub standard properties they can provide.
  • Hi All,
I really need advice on 2 issue relating to this crew!
We bought a house from Brendan almost a year ago. We have had nothing but issues from day one. I need to know where we stand from a legal point of view which is the purpose of this post.

The first issue is: We are living in a converted listed property which is over 300yr old situated within a gated complex. A complex which one year later is not still not complete. We are still awaiting BT lines, Tarmac, grass for the lawns and the gate itself is unpowered. We are supposed to be paying a service charge of £83p/m month for buildings ins, upkeep of the grounds, window cleaning and upkeep of the roof of the listed building. We and all other residents are not paying the service charge as of yet because the site is a)incomplete and b)no service has yet been provided (we all even have our own individual window cleaner and are paying our own individual buildings insurance as we don't think we are covered properly if at all) We have seen no sign of HTG for the last 3 months no builders no nothing so we are now starting to think the site will never get finished. This said, i have heard from one of the neighbours that Brendan is refusing to finish the site until we all start paying our service charges. This sticks in my throat for two reasons: 1) A service charge is a charge for providing services NOT for completing a site which should have already been finished and 2) Why should we pay a service charge for a site that barely has no grass to cut, a gate that doesnt work windows that don't get cleaned and insurance we have no proof exisits? Are we in the wrong here?

The second issue is we have had a leaking roof since day one. Everytime it rains hard (which is more regularly lately) our kitchen roof leaks in. We have owned the property less than 12 months so surely we should not have this issue. We have requested this gets sorted by HTG on 4 occasions and we have had no response at all. We have had a professional quote which states that the roof is in a dire state of repair. The felt is so degraded it crumbles in your hand and 1/3 of the tiles are broken. This surely should have been rectified when the house was converted and before we bought it shouldn't it? I need to know where to turn as this is a very expensive job, one i feel we should not be having to pay for. If we had lived in the house 10yrs then fair enough but not after just 11months.
We know the service charge from point one SHOULD cover the roof but i think we'll have better lucl finding rocking horse s**t than this being a solution. What other avenues can we go down? One question i have is how did the roof not get picked up on in the sale process? We have paperwork stating that a surveyor is liable for 6years after he passed the house as fit, could we look down this road? Are there any building guarantees protecting us at all?

Please could someone help light up this dark mess for us as we don't know where to turn and feel we are stuck in house we can't enjoy or move from as i don't think it's even saleable.
