ARLA published a report today where they felt that they manage themselves.
Always helpful to provide a link rather than just a generalised statment. Note that ARLA's spokesman says:
"........we would like to see a review of the current estate agent "negative licensing" system - which means estate agents do not need a licence. Negative licensing is wholly insufficient in protecting consumers against bad practice and we would far rather see formal, statutory regulation of estate agents - and lettings agents - be introduced. As the NAEA and ARLA, we have our own agent licensing and regulation schemes, but while there is no uniform regulation scheme effective across the UK, rogue agents who operate outside professional bodies like our own, will continue to take advantage of consumers.

Regarding the apparently reprehensible activities of Mssrs Home Trader, Brenedan Kiely, Bentley Residential Lettings Ltd. It would be surprising if the BBC and other commentators were wrong in their findings regarding these fine, upstanding & law-abiding entities. So many fair-minded and reasonable persons will conclude that the BBC and other commentators are correct: Others may hold other views.

I sincerely hope the mods leave these threads in their entireties as an exemplar of how not to handle a PR disaster..;. Further, hopefully these threads and other conversations elsewhere on t'InterWeb will ensure continued high-profile for Mssrs Home Trader, Brenedan Kiely, Bentley Residential Lettings Ltd and their apparently reprehensible activities.

It appears to many, myself included, that these gentlemen & organisations are ones that we might be better off without. Others may hold other views.

Do please continue expanding on your views sallybakersmith & danny1963, as I am unclear where you stand regarding the probity of Mssrs Home Trader, Brenedan Kiely, Bentley Residential Lettings Ltd. We are waiting with bated breath..

In reply to earlier posts I am a little surprised at the naivity, the underlying beleif that property should somehow be special, and a muddled view that conflate legislation regualtion and the role of agent and landlord.

Government refuse regulation, and under fund enforcement of housing standards in part because of the consequences; the bottom end of the private market would contract significantly creating a housing crisis and huge burden on social housing and homelessness.

Similarly they are unwilling to increase housing land supply not just because of funding but the politicisation of planning at the local level, not solely the nimby but the expectations of most people who don't want to live on or near a council/RSL estate.

Unwinding those issues takes reform on such a broad scale that should be achievable, but this Government has shown it can't, however the deferred nature of dealing with the deficit will lead to it sooner or later.

As to monopolistic or oligopolistic behaviour that is naive; very few examples of any service can be quoted, why is agency special?

Do we then have government appointed agencies to ensure competition?
Local markets are very different to another, a profitable business model might not work elsewhere, and might be priced out by competitoon if it were brought in. How do you legislate for that?

And as to education and research some comments have proved my initial point, it has been supplanted by expectation and I ask what is wrong with you?! it a huge decision and there are numerous sites and information websites that explain the in's and out and pitfalls.

Give up two episodes of east enders or Corrie, or ratther than a fag break and texting your mates updating your status as stressed, learn. http://www.direct.gov.uk/en/HomeAndCommunity/Privaterenting/index.htm

As for a limited amount of time most tenants have had at least 6 or 12 months notce, you know when the tenancy ends! most have annual elave and can use a day to move.

Unlike many western countries we are quite fortunate in a process that mostly allows a clean break between rents of either property, we don't pay first and last plus a security deposit or bond, deposits are quickly transferred. Much stress can be avoided by having a weks extra rent

As to those holding deposits the case here might be abused, but what about the tenant whose status is not as rosy as state, or they out and out lied. What about tenants who makes an agreements then say "oh we found something else" not to mention those that wait till they are called to give that news.

    I support Licensing and regulation

1:Each landlord and agent should be licensed, personally and as firm/company.

2:Each property should be registered as let.

3: renters need a Summary of rights: each local market should be free to make it's charges, but they must be stated in advance, and the process of renting and notices explained, and a simple pack of the epc and certificates and assessments

4: This silly notion of "no key or access for landlords" must be confined to history in favour of clear rights for both parties, and fixed inspections and reports to avoid the post letting deposit arguments.

5: How about credit scoring on registration? Each applicant gets scored beforehand- then it's a quick landlords reference and in in a much shorter time.

    Just a thought or two.
Stop! Think. Read the small print. Trust nothing and assume that it is your responsibility. That way it rarely goes wrong.

To be fair i think its pretty common knowledge to people where this chap lives, apart from the things like companies house where the information is available, he hardly did himself any favours having his house filmed on TV.

But then he seemed like that kind of guy that wanted to show off what hes got, shame about all the neon lights in his house though, reminded me a bit of the red light district.

    Home Trader Group PLC.

Credit check with one of the major credit reference agencies suggests that you not give them credit.

    'Cash transactions preferred' it says.

That's ironic considering cash seems to be what the company prefers as well.

5 CCJs against it in 2011 as well.

Turned over £6.7m in the year to April 2011. Lost £666k before tax.

"The auditors opinions have been limited by the information given to them"

There is a winding up petition against them (currently adjourned sine die).
