Ordered phone in July.
Received "thank you for your order" email July 31st
Received "Delivery Confirmation" email August 1st
Connected to network August 1st

Sent in December bill believing July to be month 1, December month 6.
Claim rejected as was wrong month's bill.

Who was right?

    How can July be the month 1 if you were connected in August?

    I don't see the T&C at e2save website, but I am sure you have received some information from e2save by mail and e-mail. What did it say exactly? And why have you not resubmitted the claim one month later?

    Basically, it is the same company. Don't know if the months numbers are similarly confusing.

    Not resubmitted because I've only just spotted the email they sent me in January! (Disorganised, me?:o)

    Discussions I've seen tend to talk about "purchase date" or "month of purchase" but it's not obvious to me what stage in the ordering process is the purchase date or whether that should be the same as the connection date.

    You can print the list of months to send the bill. Example for month of April is below. You should have kept the list and or check with the e2save.

    It's the bill date, not the purchase date.
    This type of cashback is not for disorganised people like yourself, who check emails every few months. if you have been checking emails every few days you could have resend the bill.

    The cashback works and you can save a lot if you are organised and willing to understand when to send bills.

    Someone like you will be better off with sim only or PAYG, non cashback as you don't need to be organised, pay the x amount a month.

    There is absolutely NO ambiguity or confusion in your case with this PARTICULAR dealer and its t&c at YOUR point of order.

    The CORRECT claim was using DECEMBER'S bill. The t&c are very clear and specific. Possibly they didn't send an order acceptance email before 1st July but ""So for example," (poor grammar but theirs, not mine!) "if you ordered on 30th January 2010, we'll need your June 2010 bill for your first claim".

    They have probably made an error in that the confirmation email was dated 1st August, making the claim one month later IF that was in the t&c. The above quote above is from the t&c ruling on 22nd July 2010.

    I'm afraid there are many like you who think they merely need to send the right bill at the right time and then wait for the cheque to arrive; many on here constantly advise people that it's as simple as that (which it often is). However, if you don't do this properly you are asking for trouble with any cashback scheme. I would never have allowed any of the people I watch over to get into this postion this far down the track.

    You should draft a PROPER Letter Before Legal proceedings and send it to the parent company (CPW) at its registered address AND email a copy to E2Save. Quote the t&c, which make it quite clear (even, if needbe, in a court of law) that the December bill was unjustifiably rejected and that payment should be made within 7 days. You will find information on LBA's on this site if you search. Before doing that, I would try sending a a reasonable email pointing out their mistake and asking them to correct their decision immediately. If their response is anything other than payment, send the LBA.

    You are lucky; you can still force them to pay. However, having to even ask the original question displays a lack of understanding of how cashback schemes work and what you need to do in order to virtually guarantee you get your money!

    By the way, the advice (given in good faith) to stick to instructions in emails and/or on their website is VERY dangerous. ALL CPW clones have a long history of contradictory information and WRONG dates in BOTH those instances. I am dealing with one of my people now who has been told one set of dates on the website (which are WRONG!) and different dates in their emails and letter receipts. Fortunately I am used to this but if you aren't then the advice given can be highly dangerous! The rule is quite simple (as always); follow the guidelines (MINE, not theirs) and make certain you understand exactly what you need to do, when you need to do it, prove that you have done it and know what immediate action to take when something goes wrong.

    For e2save, if the first bill received was dated August, then the 6th bill will be dated January and that is the one that should have been submitted.

    The terms are as I QUOTED and were the ones in operation at that time. To quote more:-

    "the month you purchased your handset, regardless of the date of the month, counts as month 1".

    The date of the bill is irrelevant; only the month. It is completely different to Mobiles.co - though of late they have been sending out t&c akin to E2Save even though they apply something completely different.

    However, Oneaday gives lots of advice - much of it a LONG time before he actually used any of these dealers - and his understanding of the t&c and a LOT of other things besides hasn't improved one jot.
