  • I agree, but be careful not to confuse RPI with CPI (there is a difference). From the same National Statistics website i get RPI to be :

    March 3.6%
    February 3.7%
    January 3.9%
    December 4.8%

    and so on and so on... the get out is the March RPI at 3.6% as far as i can see.

    To me this would definately stand up in court.

    Sorry - your figures are right and I hit the wrong table.

    If they notified you in March, then the March figures would not have been available till mid April and the t&c refer to the 12 months preceding the month in which they notified you. 3.7% would then be valid as that was the lowest figure in the preceding 12 months.

    But if you were notified in April or even next month, then you should be ok as the RPI for March was, as you wrote, 3.6%

    Sounds a good explanation of point 7.2.3.3, I sent an email to cancel 3 days ago but still not heard anything back from them, perhaps i should try again with this.

    hi do you have an exact email you sent them to get out please? abviously minus any sensitive info , just want a sort of templete kind of thing so i can do same, its worth a try

    on looking at it again wouldnt t mobile have noticed this before the change, to rule out any unwanted cancellations? or did they miss the 3.6% figure for march

    The March figures are not available till April 15th or so. They announced the increase on March 28th or so, but if they didn't notify you till April, then they have slipped up.

    Has anyone had success with this? I have complained and they just quoted the 3.7% increase was in line with RPI.

    I managed to get to speak to someone and they said that as the SENT me notification on 28th March that this was correct to their t&c & that I should take the issue up with Royal Mail as I did not receive their letter until April 4th.

    The issue relates to 7.2.3.3 and the wording is when they send notification, not when we receive it. I think this is not a get out of the contract unless they didn't send the notification until April?

    I tried to cancel due the rise being of material detriment to me, being as was made redundant at the start of the month.

    They just emailed back quoting the terms and conditions and saying that they don't feel that it is of material detriment.

    correct, marchs Rpi wont be sent till mid april, so this isnt a get out clause sadly
  • I'm still trying - I'm sure that the ts&cs are unfair so I'm just about to take them to the small claims court and so have had to put in my claim for the amount of time I've spent chasing them...

    So they're now looking at a bill for nearly £500 when they could have just given me two PACs...

    I'll report back if I have any luck
