vodafone charging me for a phone i didnt have / help!

    If she dialled 191 from her Vodafone phone, then I doubt the call would appear on a bill sent out to a customer; maybe another Vodafone customer could confirm. However, Vodafone will probably have a record of all outgoing calls, chargeable or not, made using a particular SIM card. It is this hidden data that Vodafone will need to access.

    It is worth noting, that in the T&C Vodafone say "written notice".
    In the FAQ they say:
    Pay monthly
    If you want to end your contract, please write to us giving 30 days notice - you can send us a letter or an email.Please give us the following information :

    • the account name, and account number
    • the invoice address
    • the mobile number to be terminated
    • the date of termination
    • the name of the account owner or administrator
    • tell us if you need a PAC (Porting Authorisation Code)
    • if the account has a password, please quote this in your letter or email.

    if money is so tight how can you not notice 45 pounds coming out of your account?

    i dont understand this at all i notice if an extra pound comes out

    if you can prove she cancelled go down that route other than that id say keep an eye on your bank account in future

    when i see the contract, i will look for a clause with something like 'vodafone will provide ..... this and that' has anyone ever gone down that route, thanks for the responses however i have sent out a letter detailing the consumer credit act before to orange since a phone contract is essentially a hire agreement.

    She is very busy and didnt notice it going out, it can happen that some people are more naive than others and take companies at there word, no one ever mentioned to her to put it in writting, i think it a sad state of affairs that everytime we pick up the phone we must get a name, ext number, date and time and that we all have to check our terms and conditions for things such as this, i find it totally insane that a system has been set up where by a company has taken £600 from someone and not provided anything and is still allowed to charge them £123, however we will have to see what trading standards say before i get a deffinative answer.

    Why do you think that? What are you hiring?

    A mobile phone contract is for the provision of a service, often with a related contract for the supply of goods, both of which are governed by the Supply of Goods and Services Act 1982.

    maybe im wrong about it being a hire agreement, it is probably more likely to be a credit agreement then since in some cases you have to undergo a credit check before you can have a particular phone deal, i dont profess to know alot about the law, im not a solicitor and im not experienced in these sorts of matters but that is why i have messaged here, to learn and to seek advice not to be screwtinized upon what i know and dont know

    If you state as fact something that is wrong, people will indeed scrutinise you; if you ask questions, people will do their best to give you answers as they have above.

    Well, if the debt is real, then the rights are:
    • To pay the debt.
    • Not to pay. Get default record in the credit files and debt collectors knocking on the door, then, in the worst case scenario, bailiffs.
    For more complicated options like bankruptcy, IVA etc see Debt-Free Wannabe and Bankruptcy & Living With It boards.

    No it's a service agreement not a credit agreement.
