As a sidenote what are your thoughts on her not recieving a handset when the contract rolled over
What handset did she ask for?

in the past whenever she didnt want a contract to roll over a call to a customer service department was enough to give them notice.

This time vodafone are argueing that because she didnt give 30 days written notice which is in the terms and conditions (fair enough) that the account is still active.

she never recieved a phone/handset from vodafone, rather her current provider orange provided the phone and its a blackberry.

You are asking for "thoughts on her not recieving a handset [from Vodafone] when the contract rolled over". What handset did she ask Vodafone for?

she never thought to ask because she thought her contract had ended with vodafone as per the now phantom phone call vodafone says she didnt make

If she didn't ask Vodafone for a new handset, why do you expect her to have received one from Vodafone? Am I missing something?

i see your point, its just that since the contract rolled over she never had a phone that was using vodafones network

How were Vodafone supposed to know that she had given her old phone to Orange? Did she tell Vodafone this?

that would be something i would have to clarify with her, though i suppose it wouldnt matter whether she did or didnt considering there denying being called in the first place.

so would you then say she was at fault and she should pay the remainder

Yes, two things she failed to do:
    • She didn't keep a record of the date and time of the call and the person's name when she contacted Vodafone to cancel the contract.
    • She didn't query the monthly amounts that Vodafone were continuing to take from her bank account.
I think she's just going to have to pay it, unless she can get a goodwill gesture out of Vodafone. As she didn't even notice the money going out of her account for 7 months, it can't be a lot of money for her.
