i was mi-sold ppi back in june 2004. I tried claiming it back but found the company had gone bust. I then followed the route of writing to FSCS who have informed that because the now dissolved finance company did not become FSA regulated until jan 2005 there is nothing i can do to reclaim the mis sold ppi.
The whole lump sum of the PPI was added to my loan and i was told it was compulsary with the loan i was looking at.

am i really to accept that i have lost my cash?

Game over. You have no-one to complain to as they failed prior to regulation and consumer protection.

The method you are using does not apply to closed accounts.

What exactly are you after? You dont need the agreement to make a complaint.
I was looking into claiming back my PPI on past loans. I didn't realise closed accounts are treated differently. I guess the method I'm using is for current loans?

So should I just get to the point with past loans and ask for PPI?

    Thanks for your response.

just wondering if anyone can offer any advice on what to do next . i sent a letter to my bank to claim back my ppi from loans ive had in the past.i received a letter asking for four weeks, 3 weeks later i received the same letter asking for a further four weeks and now today ive received this-

''do to the time elapsed:we are unable to investigate any loans you have held with this bank. If you are in possession of your original loan agreements can you arrange to send these to the above address in order that we can review and investigate your complaint further.''

the problem i have is i do not have any of my original loan agreements anymore, the loans date back to 1998/1999 up until about 2006 ish. we moved house in 2007 and i burnt all the loan documentation as everything was all paid up.

can anyone advise me on what i should do next? (if there is anythign i can do)

    thank you
  • After getting a copy of my credit history, I wrote several letters using the template provided to request copies of the credit agreement for the accounts to see if there was ppi on them.
I have received 3 responses saying that they are not obliged to provide the information I requested and says "the right to be provided with this information ended with the closure of the account Is this correct?
I feel I have bee thwarted at the first hurdle !!! Not to mention robbed of the cost of 10 stamps lol!

There is nothing you can do. If neither you nor the bank hold any relevant information there is nothing to go on with regards to a complaint.

You also burnt any chance of your complaint being successful.

I contacted my catalogue company, as they had charged me PPI ppremiums for several years when I opened the account. They say that although my account was opened in February 1989, they only have information on transactions on my account since 2005 and anything earlier has been destroyed "in line with the Data Protection Act". I only have statements going back one year - should I believe them or push them through the Information Commission?

Companies are required to destroy data no longer required. The FSA recommend 6 years. Their response is consistent with what you would expect. Unless you can provide statements, the FOS will not change that position.

  • Hi,

In 2004 my wife ad I took out a joint credit card with MINT to pay for our wedding on 0% interest free credit over 18 months.

We also had a car loan through Tesco in the same year.

I have since paid off all the balances on both accounts and therefore closed them. I have also shredded all paperwork I had.

Is there a way to check as to whether I unknowingly had PPI added to either of these?

    Thanks

I took out a loan with RBS around 3 years ago and have since had a look at the documents i had for my load agreement. While i couldn't see anything on there referencing PPI in any way (or payment protection etc), there wasn't much info on the documents i had. I sent off the std letter from the MSE website and eventually RBS came back to me saying they coulodn't find my loan agreement.

While i was adivised that this doesn't mean my loan is void or anything, where does this leave me regarding PPI?

    Thanks

    Jonathan

Can anyone offer me any advice about this?????

    Thanks

    Jonny
