PPI Reclaiming Discussion Part 5

Banks have been building a database of employer benefits. Where they have employer benefits on file, they use those against any allegation you make (e.g. if you said you got 12 months sick pay, they check their database and if it agrees with you then fine, if not they ask you to provide evidence).
So, they need to ask questions in areas they do not know. It is quite probable in some areas they do know or have a record on that file that says one thing. They are looking to see if you say the same. If not, that could be a potential complaint area that needs addressing.
So, in some areas, they may catch out liars trying it on. However, they may also find areas you didnt complain about but are actually a valid reason for complaint.I am an Independent Financial Adviser (IFA). I was a bit skeptical about PPI claims, but knew I had paid PPI regularly on a credit card back in the 1980s and 1990s when interest rates were through the roof. At the time I was not able to make full payments each month so paid a lot of PPI on outstanding the balance, even though I was in full time employment with good sickness and redundancy benefits. I did not have details of the account except the name of the credit card company MBNA and the approximate time frame. I used the MSE PPI tool, MBNA investigated and found a number of accounts. All my claims were reject apart from one - I assume the account I knew I had paid PPI on. Just got a letter confirming a settlement of over £4,700! That's next year's holiday sorted. :money:0

Hi all
It is some time since I last posted, probably around the time the ombudsman rejected my claim which frustrated me but what can you, despite being paid out by all the others....
Couple of questions
1. Does anyone know if MBNA were part of this High Commission on Credit Cards?
2. Is it best to wait till 29th August to restart my claim based on 'Plevin'?
3. DO you only get the difference back form the commission or is it the full amount as before under the product was mis-sold?
Thank you in advance0 -

as yet unknown. Most credit cards are expected to be a little under or a little over 50%. Only one card provider is known to have replied on Plevin and theirs was under 50%.2. Is it best to wait till 29th August to restart my claim based on 'Plevin'?
your complaint is not restarted. You are just asking to see if Plevin applies to you or not.3. DO you only get the difference back form the commission or is it the full amount as before under the product was mis-sold?
Only the excess over 50%. So, if the commission was say 52%, you would get the 2% back.I am an Independent Financial Adviser (IFA). Hello,
Is it ok to write to a bank/finance/credit company to ask whether I had PPI or not?
I know that since approx 2004 I have made a point of making sure that I didnt take PPI out as by then I had learnt that I didnt want it, especially following my joining the Moneysavingexport forum.
But over the years prior to 2004, I have had various credit cards and loans, a lot I cant remember, but some I do ie RBS, Natwest, Alliance and Leicester. generally after paying off/closing the accounts I would have discarded the paper (usually after 5 years of being closed).
Is there a letter template I can use.smile --- it makes people wonder what you are up to....

Contact the banks that you know, just give as much info as you can to help them find you.
You do not need a template, just call them.0 -
From what I could understand of all that, you had a need for the policy (no other way of making repayments) and were eligible.
Seems ok.0 -

Thanks for the response, although it seems there is a bit of misinterpretation of my post. Probably due to the length of it! When I said no way of making repayments, it is talking in the sense of no other way of paying the policy premium to keep the policy running. This is how it asks it on the form as they look at how you would have paid for the policy each month if you hadn't had sick pay etc. In their response they have used it in a way to say I could have still paid for the policy each month as I would get employer sick pay, not in sense that I needed the policy as i'd have no way of paying bills. Apologies if that didn't come across clear. I have now deleted the post as I realise the story is too lengthy to be clear what I am asking.0 -

Some types of PPI wont pay out if there is employer sick pay. Where your PPI policy does, it is not missold in that respect.I am an Independent Financial Adviser (IFA). Thanks for the reply. I didn't state that my policy would pay out if I had company sick pay, so I am unsure where that has come from. I was saying I had company sick/redundancy pay so I didn't need the policy. They have said I had relevant sick pay so I could still pay the premiums each month but have not addressed the point that I already had relevant cover from the employer. I don't actually know if they would pay out or not if I had company sick pay as they didn't ask what I would get and it wasn't explained on the call where it was sold. I also did not receive any paperwork to show what the policy covered etc. The photocopied leaflet they sent me recently was not sent to me at the time and appears to be a basic information of terms and conditions and doesn't detail any costs etc. It mentions certificate to show what I am covered for but I didn't get one of those either. I have now deleted the post as I realise it is too long to understand properly and is being misinterpreted. Basically the things that this website and other websites say you should have been told when it is being sold to you, they didn't do that on my call and they haven't got the recording for me to be able to prove they didn't, but any links directly to the 3 letters would be appreciated. Thanks0
