    You could send a SAR and £10 to see what info they have left, don't confuse this with a CCA request and £1 because you won't get that.

    Sorry I forgot to ask on my reply before, regarding your last comment about it just being for info not a support site for the pointers I wanted, is there a section like that on this site? That is part of my original problem and why I came here, as I have seen pages where people are discussing their cases and people responding with help and advice or pointers what they could do etc. I found the ma while ago when searching on google but I didn't save the page and can't seem to find it since. I have found others on consumer action group site so may have to try there if nothing on here. Thanks again

    Hubby had a phone call from Bank of Scotland yesterday with follow up questions re a claim we submitted via the resolver tool. It ended with the guy asking which bank account would we want any monies paid into if any refund is due, he also said it could take upto 6 weeks to process any monies.

    Is that normal to ask that or am I feeling hopeful when I shouldn't be? Would be grateful for any help, thanks.

    I used resolver to claim PPI from the Hallifax (which comes under the same parent company as the Bank of Scottland I think) on the 22 June. I to had a phone call with follow up questions and was ask which bank account I wanted any monies owed paid into. On Monday 21 Aug I received a letter to say my claim was successful and monies would be in my account with 5 days, it was actually put in that day.

    Thanks for your response. After trawling through the thread for ages yesterday I eventually found a similar post to mine with a reply similar to yours.

    I did have, & pay premiums for, PPI on this mortgage - my very first as it was intimated that if I agreed to take it out before I made the mortgage application that the application would be viewed more favourably and when it was approved I was also given scary scenarios about what would happen if I became ill, unemployed or other reasons I may not be able to keep up repayments. Can't believe I fell for it as I would have been eligible for sick pay from my employer but I was very young and naïve then.

    I used to keep all documentation until it became much easier to transfer mortgages to other providers and have since had mortgages with up to 8-10 other providers and when I checked with my financial advisor if I should keep all this when I moved a couple of years ago he said to ditch it as the banks would always have a record of everything. O well, lesson learned.

    May give them a ring tomorrow and see what they say anyway.

    I've just googled SAR letter (knew nothing about this) and found a template on MSE so I'm presuming I just fill out the template & enclose £10 payment & send it this company? Will have another read when I have more time.

    Your experience sounds similar to mine initially. I too used Resolver and it was for a mortgage account with Halifax - see my original post above.

    Do you mind me asking if the account you claimed successfully against was quite new? & if you had kept any proof of payments of PPI?

    If I'm not mistaken I'm understanding from your post that they seemed to agree to repay quite quickly without proof of payment after the check phone call. I also had this but then a letter a couple of days ago asking for proof of payments/documentation as detailed in my original post & I just wondered if this was because my account dated back to 1988?

    Sorry if you think I'm being nosey - just wondered why I need to provide evidence. Not had chance to ring them today due to work commitments as they close at 5.

    Congratulations again - great to hear a success story.

    The experience of others is not really relevant to you, I'm afraid. Banks (and complainants) either have records/documents or they don't. If neither have records then any complaint is dead before it begins.

    Generally, the older the finance the less chance records have been kept. It helps if the complainant is still a customer of the financial institution, but even then it's not guaranteed.

    You are making a complaint 29 years on from the event and I sincerely doubt even a SAR will turn up anything after so long.

    I haven't seen something like that but basically, every case is different but similar in th types of response you should be giving to make a sucessful complaint.
    Some companies will roll over, some won't, some require proof, some won't.

    If you asked for a CCA they don't have to provide one unless the account is open, and a lot of people use a request like that to try and see if a debt is unenforceable.

    A SAR is different and you need to send it and £10. This doesn't mean you'll get any more info than you already have because companies are only [sort of] obliged to keep info for 6 years [reccomended by the FCA]

    I suspect companies are being a lot more diligent lately about removing old records


    As before, you can send a SAR but it may not help you as much as you think it will. However, it's your choice.
    Don't forget you have 6 months to go to the FOS and that's it, no extra time allowed unless something realy drastic happens so don't dilly dally, get your complaint in as soon as you can.

  • PPI complaints logged about 6 weeks ago with the Halifax for credit card and loans held with them in the past. Received standard acknowledgment text.

    About a fortnight ago I got a call to go through my complaint regarding the credit card as PPI had been found. I answered the questions as honestly as I could remember, bearing in mind it was a taken out a long time ago! The lady said she would continue her investigation and be in touch with her findings within the timeframe given.

    Expected a call regarding the loans but received nothing other than a text to say they are coming to the end of their investigation and to expect a response in due course.

    I was under the impression by the first letter I received from the Halifax that they follow most complaints up with a phone call, rightly, but probably wrongly therefore, I am "assuming" that the case for the loans has amounted to nothing as they haven't spoken with me about them.

    Whilst I'm not expecting anyone to predict the outcome of their findings; having not put in a PPI complaint before now, I am keen to ascertain if anyone has encountered a similar situation.
