    I doubt you'll have much luck reclaiming late charges.

    To complain, either fill in the ombudsman form here [step 3] or phone and complain. It makes no odds whether you complain as to the status of the account but if you're in arrears or deafult, if you do have a successful complaint, they can use the redress [ partial or whole] against the account.

  • Hi -taff. Thanks for replying.

    I no longer have a credit card with MBNA. I paid it off in 2009. If I was successful with late charges and over limit fees would they be able to put that money towards the loan I have with them instead of sending me a cheque?

    Or did you mean that you think I won't be successful in claiming PPI from the credit card I used to have with them?
  • I'm looking through some papers and have just found some more correspondence with MBNA.

    I cancelled my Payment Protection Cover with them in 2008. They then applied a rebate of nearly £1000 on my loan account at the time. That's what they called it - a rebate. They, in effect, gave me money after I cancelled my PPI.

    Can I still try to claim from them for mis-selling PPI to me or was that 'rebate' actually what they owed me for PPI? It has confused me now.

    I mean that if your loan complaint is successful, if the company hasn't sold it on, they can use the redrfess against your debt.

    I have no idea what the rebate was for....

  • Ok. Well, Arrow Global now deal with my loan. In March 2010, I received a letter from them saying that MBNA 'has assigned all of its respective rights, title and interest in respect of' my account. So I suppose MBNA sold it to them.

    Does this mean I should send a reclaim letter to Arrow instead of MBNA? I thought I'd read somewhere that for PPI you still had to claim from the original lender. No?

    If it has been completely sold on, they can't use any redress against it.

    If it makes things any better, Cap One have a very good reputation with complaint handling and the FOS stats show that they overturn very few of Cap One complaints. So, statistically you probably wouldnt have won your complaint at the FOS.


    thanks for the reply we originally got refused and then I asked them to re-look at it ... when the second refusal letter came i thought we had 6 months from the second letter not the first.... Hubby was made redundant within this time andhad to get a job in London so was working away ... will give it a go explaining we've got nothing to loose x

    Generally speaking if you were given your FOS rights in the original letter the six months runs from that date.

    If you by any chance weren't given them then the clock doesn't start running until you are, so you're in luck

    It is standard with single premium PPI. Because the premium is added to the loan upfront, if you cancel early there is a rebate of the unused premium paid which is deducted from the loan balance.
