    So once I went into payment arrangement I effectively had a second loan? Is that how it would be viewed in the eyes of the FOS?

    If this is the case as I understand it your advice would be to claim on the loan as it was after I went into payment arrangement with the same reasons that got me an offer on the same loan before arrangement?


    If I accept the first claim - on the letter it states: "I accept on the basis that such an offer is accepted in full and final settlement of all or any claims against RBS/Lombard on the account no.<stated>"
    If I accept the first doesn't this leave them washing their hands? Getting nervous now since its nearly a month since I received the offer....

    I have just looked at your original post, they are paying you redress and this will be as per FOS rule, I did not read your original post right, sorry, I would accept the offer as you cannot claim for being off work as you were not off for at least a month, over 3,000 is a decent sum for an old loan.

    Did you have any other loans with these? if you did and you were mis sold, then only accept the offer of this one with the proviso you will be making another claim for any other loans with them.

    If you only had this one loan, take the money and enjoy.

    Hi

    Looking for a bit of advice please. My husband and I have had many loans and credit cards over the last 15+ yrs and I'm 99.9% sure that we've had PPI on one or two of them but not in the last few years since I realised they weren't worth having. I have ordered my credit reports so have the last 6 years worth of info but nothing prior to that. I have no idea who I would have had credit cards or loans with and everything is shredded when I've settled a loan or cleared a card etc. I'm doubtful that I'll be able to claim anything from the last six years. Is it really worth sending SARs to multiple companies at £20 a time to see if they've got any paperwork? How far back will they keep our information anyway? How far back can I claim PPI? I know I always took it out in the 90s but got wise to it after that lol.

    SAR letters cost £10 each, but the information you'll receive is entirely dependant on what the individual bank still has on record for you. There are no guarantees for anything over six years old I'm afraid.

  • Wondering if any knows the answer to this.

    I'm claiming PPI back from MBNA. They refused to pay me anything as they said I had click a box agreeing to PPI.
    Anyway I'm disputing this verdict and have appealed to the Financial Ombudsman. The Financial Ombudsman has written to me a few times saying my appeal could take a year as they have a backlog etc etc.
    I was rushing leaving the house this morning on my way to work. I listened to my messages on my answer machine on my landline before I left the house and there was a message (yesterday) from the Financial Ombudsman asking me to call them.
    I'm not allowed to make outgoing calls at work so will have to wait until I can return their call. I was just wondering is this common that they phone? Is this a good sign? Or a bad sign?

    Yes it is. Usually where unpersonalised template letters are used or insufficient information is available or unclear information exists.
    I would have thought they would have written to me if they wanted any more info etc etc

    Quicker to phone and hear it straight from you.
