I probably know the answer to this but looyds have offered me a settlement for PPI
However as I am in a debt management plan and owe Lloyds more then the figure offered they have said that the settlement will be used to pay off arrears.
I did want to use money to pay off council tax but it seems there's no way round this althoughthey have said on the form there is a number i can ring if i want to use settlement for something else , anyone got any advice for this or any sucesses?0 -

They can do this if they want to. You could ask them if you can use it for a more pressing debt, they may say yes.Non me fac calcitrare tuum culi0

Just had my final response from egg stating that:
They did not require me to take out CRP (PPI) to get the card
Did not provide an advisory service
Required me to positively confirm i wanted ppi on the site
Gave me full T's & C's about ppi
I did a sar request, and none of the documents showed my online application or where I had requested PPI. I also had a loan to pay off the card which I included in this claim. Of which they seem to have lumped together with the original card claim..
Do they have valid reasons? It sound like a fob off to me (and I cannot see how they are proving it as I have the same paperwork)

Well, unles you can show the boxes werre pre-ticked [ round about 1999-2001] or you had some time-outs when applying, then you have missbought, not been missold.
The loan should have been upheld/denied separately, not lumped into the same denial if that makes sense.Non me fac calcitrare tuum culi0 -

HSBC contacted me via a letter to say that they believe I may have been missold PPI in 2 circumstances, one was misselling straight up and the other was when i consolidated/ refinanced a loan. I filled out the questionaire as I was not aware I had even got PPI on these loans which is why I had not considered making an application before. They sent me a letter a week ago saying that they were looking at 3 graduate loans and they would contact me within 8 weeks to let me know the outcome, the loans were £5,000, £11,000 and £17,000, all went to the term of the loan and were never in default. Has anybody had this happen to them? Do you know what level the level of success is if they invite you to claim? I have no paperwork as the last loan was settled 4-5 years ago so I have no clue how much to expect if anything at all.

If you win mis sell, you will get the whole PPI amounts back and the 8% less any rebate they gave for the consolidation loans.0 -

With your status at the time of the loan, I would imagine that you had a need of this insurance,the life part anyway, having said that, you could argue that you tried to make a claim and "stress" was not covered but you would still have needed the life insurance, being on your own with 2 children.they say they are confident I would have taken the alternative policy had it been offered and are therefore refunding the difference in price between the single policy and standard policy.
You went off work sick with stress and were unable to repay the credit, had you been able to claim on the PPI and stress was covered, they would only have paid the credit for 12 months, how would you have made the payments after this?, this is not a criticism by the way, I am trying to show that you cannot show you had no need of any of the cover.
You may just have to accept the redress and move on, there is no point me telling you to reject the offer on the basis that you did not need it, you clearly needed the life insurance, you could argue the point that had the PPI covered you for the stress, a 12 month claim would have been made, you would then need to prove that you could have repaid the credit after the 12 months and going forward, see what I mean?.
Argue the point regarding the PPI not covering you and ask them if the alternative cover would have paid out for stress and if it did not then the PPI, at that point, was of no use to you, you may as well ask because you will be no worse off than you are now if they refuse, you could take
this to FOS if you still don't agree but be prepared for a long wait.
You need to see if the PPI covered you for stress, if it did not, use the same argument again as for the loan.Halifax 3 x credit cards rejected all 3 saying I tickedthe PPI box on the CCA which I most certainly did not. I am currently waiting on an SAR to see these ticks.
if you paid the PPI in with this loan monthly payment, this is single premium PPI, reject the decision on this basis, if this did not cover for stress then use that reason as well, same with Halifax if it was Single Premium.Lloyds TSB £6000 loan.The CCA shows are computer generated X for PPI. there is only 2 signatures on the whole agreement...1 for acceptance of loan and other for agreeing to direct debit!Lloyds Rejected saying the signature for the loan also acted as an additional consent signature required for the PPI!!
So you had redress for this but are arguing that Welcome did not mention PPI to you or the FOS? sorry, don't know what answer you need to this.Welcome finance £2000 loan. I opened a separate complaint against welcome in 2010 regarding handling of my settlement. The ombudsman ruled in my favour. At no point during the life of the loan or throughout the 2year complaint did they bring it to mine or the FOS’s attention even when asked by the FOS to recalculate the settlement they did not mention any PPI on the loan or in any calculations. Had myself or the Ombudsman known or been made aware of PPI then surely PPI questions would have been raised ? so they concealed it from the ombudsman too?
Same with this as Lloyds and Halifax.M&S £5000 loan Signature in PPI box is not the same as my others on agreement and looks significantly different so I suspect it has been fraudulently done. They have had my complaint for over 8 weeks and they still cannot tell me anything.
Sometimes PPI on a card is put on after a telephone call to the card holder, if your partner was mis sold then send the claim to the FOS.When he complained about it they said he took it out on the day he took the card out which he did not consent to or know about. Then another advisor told him he had not always had PPI on the card, saying it started after the card start date?
