PPI Reclaiming Discussion Part 5

It's what his mortgage adviser would have produced to tell him what insurances he recommended for him in order for him to protect himself against losing his job, dying etc.
Of course he can take it to the ombudsman, but the likeliehood is that he will fail again.
The first one is his own fault for not checking his direct debits, and he may be able to get a refund if he asks nicely, but as it's his own fault, they may or they may not. - and he has been offered this so if he doesn't take it, they won't uphold a complaint based on the fact he forgot to cancel a DD.
The second one, if he was told it was compulsory in order to get the mortgage, then it was. He will have paperwork somewhere to say this, he's just forgotten.Non me fac calcitrare tuum culi0 -
thanks for clearing that up for me
i'd just like to clarify that i meant he was missold by being led to believe that he had to take their ppi and not get it elsewhere.
but i will get him to check for any paperwork
thanks again0 -
can nationwide club both claims together?
the letter reads like theyve made this offer to refund the 1st one and if he accepts that will close both complaints0 -
Yes they can.Non me fac calcitrare tuum culi0

Hi,
I had PPI on a loan from Lloyds which I never remembered taking on it. I contactced Lloyds last year who then replied saying that they had looked into my complaint but that there was sufficient records that they had which supported my PPI application. They said I could appeal this within the specified time and which I did by letter stating my case against this.
I have never heard anything back but am assuming that the letter may have not reached them and that they have now closed my complaint.
So, can I start a new complaint for the same claim??? Not sure myself. Any help and advice appreciated.

No you can't. If your first full and final response letter was more than 6 months ago, you have lost your chance to refer your complaint to the FOS as well.Non me fac calcitrare tuum culi0

Find out if they received your letter, if they did not then you need to ask them to look at this as you have had no response from them, they should have let you know if the complaint was closed.0 -
Hi there,
I would much appreciate any feedback or similar experiences on my PPI complaint. I am new to this and apologise for long thread but would really appreciate some honest thoughts on my PPI complaint situation.
I came out of work in 2006 for severe stress and was signed off by my GP for 12 months. I would not be returning to that place of employment. I owned my own home and was a single parent of 2 children aged 12and 14. I had multiple loans, credit cards and had over £30,000 of unsecured debt as well as my mortgage. I made all my creditors aware of my situation and sought advice from the CAB.
I had taken TMP out on my mortgage and PPI on a £10,000 loan that I held with Halifax. These are only times I had knowingly taken protection of this kind out. I claimed on the mortgage TMP and they paid it for2 months until I missed the monthly premium due to my situation. I also claimed on the £10,000 loan PPI with Halifax which they rejected saying “stress” was an exemption of the policy!! This had not been explained at the point of sale.
Faced with mortgage, debt, reminders, default notices, bank charges, credit card charges and threatened court action the CAB did an income and expenditure and made me aware of my choices. IVA, Bankruptcy or sell the home myself release what equity I had and repay the creditors. I chose to sell it knowing if the bank took it no one would get any of their money back, also I knew that bankruptcy or IVA against your name never really goes away and could affect me in later life.
I kept in close communication with my creditors paying token payments when and where I could and in Jan 2007 I sold my home, got settlement figures and repaid my creditors Barr a couple that I came to arrangements with, as my debt was higher than my equity.
It has been a difficult and challenging journey back ever since in every respect including financially.
A couple of months ago a friend and I were talking and she mentioned how she claimed back PPI on accounts of which she did not know she had and urged me to look into it.
I came on here to find out what it was all about and how it was missold. Shocked at realising banks had added it without customers knowledge in some cases. I called all my previous creditors to ask if PPI was on my loans, cards etc, and was startled that out of 14 accounts 12 had PPI on, 10 of which I knew nothing about. I opened complaints on them independently and gave my reasons that PPI had been added without my knowledge or consent. Stating if I had knowingly taken out PPI and paid for something to safeguard me in the situation I found myself in 6 years ago then surely I would have been expected to make a claim at that time seen as they were all made aware of my situation. Ialso mentioned that at no time throughout that period despite all my communication with them did any of my creditors say to me “ do you realise that you have PPI on this loan or credit card?” I also complained against my £10,000 Halifax loan stating the exclusions were not explained nor did they explain the way in which the PPI was a loan added on to my loan and accruing interest on the whole loan amount. Here’s where I am upto:
Halifax £10,000 loan and a Halifax £7,000 loan... they have written a final response PART upholding? They also sent me 2 cheques which I received the same day for the part settlement before even asking if I accepted their offer which I have not cashed as I disagree with the Part upheld decision. They say that both single policies were suitable and that I was eligible. YET in their conclusion on next page they say the single policy was NOT suitable as there was an alternative product of a standard policy which should have been offered by the advisor but wasn’t and that would have provided me with the same amount of cover, been a lot cheaper and would have been suitable, they say they are confident I would have taken the alternative policy had it been offered and are therefore refunding the difference in price between the single policy and standard policy. This is frustrating as I did not even take PPI out on £7000 loan so either policy would have been added without myknowledge and regarding the £10,000 loan neither policy would have been suitable seen as the exclusions were not explained therefore they would have rejected my claim in 2006 anyway even if I had been given the option of the standard policy .Do I take the money and run or pursue for a fully upheld complaint? Can they say a policy is suitable and then contradict themselves saying it was NOT suitable? Surely it either IS or IS NOT missold and cannot say well it was a little bit missold or it was part missold??
Halifax 3 x credit cards rejected all 3 saying I tickedthe PPI box on the CCA which I most certainly did not. I am currently waiting on an SAR to see these ticks.
Lloyds TSB £6000 loan. The CCA shows are computer generated X for PPI. there is only 2 signatures on the whole agreement...1 for acceptance of loan and other for agreeing to direct debit!Lloyds Rejected saying the signature for the loan also acted as an additional consent signature required for the PPI!!
M&S £5000 loan Signature in PPI box is not the same as my others on agreement and looks significantly different so I suspect it has been fraudulently done. They have had my complaint for over 8 weeks and they still cannot tell me anything.
Welcome finance £2000 loan. I opened a separate complaint against welcome in 2010 regarding handling of my settlement. The ombudsman ruled in my favour. At no point during the life of the loan or throughout the 2year complaint did they bring it to mine or the FOS’s attention even when asked by the FOS to recalculate the settlement they did not mention any PPI on the loan or in any calculations. Had myself or the Ombudsman known or been made aware of PPI then surely PPI questions would have been raised ? so they concealed it from the ombudsman too?
Finally my partner has had a Barclay card since 2007. After realising many PPI’s had been added to mine he checked his card and was shocked to find PPI was on it. He has been self employed for the last 4 years. Barclaycard have been giving us mixed info regarding details of the card and PPI and so he has requested an SAR. He never noticed the PPI coming out every month as when he gets the statements he just checks what the payment is and the due date and then shreds them after he receives the next one. When he complained about it they said he took it out on the day he took the card out which he did not consent to or know about. Then another advisor told him he had not always had PPI on the card, saying it started after the card start date? which is even more alarming! In addition My partner says he’s positive he applied via post but Barclaycard say it was done online yet my partner didn’t even own a computer then, and then they say in their final response rejection letter that they are satisfied the advisor made clear all the exclusion’s, limitations, cost etc and that he was eligible implying it was now a face to face meeting? Confused!!
This is proving very hard work !! Drained.com any advice or similar experiences shared would be greatly appreciated.
Promise this will be my first and last thread of this length. i just wanted to post a clear picture

Hi,
I got a Loan out with nationwide in 2010, i applied for this online but had to physcially go to the branch to sign my confirmation.
The Loan was also paid off early.
Would a PPI claim be valid to that situation?0 -
You need to look here for reasons for mis sell of the insurance
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#step2
It does not matter how you applied it is how you were sold the insurance.
If any/all the reasons for mis sell apply to you then put a claim in.0
