They won't force you to do that, they'll just give you the reamaining balance, but they could just give you the cheque or credit the redress to your bank account.
Thanks - so the money will be mine to do what I please with? I was concerned that they might "set-off" the rebate on my current loan, but as far as I can tell, this only applies to credit agreements where a customer is in arrears?0 -
Give it a try. The FOS requires that any complaint is investigated and sometimes the reason for a complaint actually being upheld is not the one that the buyer actually used to complain. So it's always worth a try.
Ok, thanks for the advice - so do I just write to Bank of Scotland in the 1st instance, saying I feel I was mid-sold the insurance (even though I've signed the box saying I want it?!), and take it from there.
Am slightly worried about repercussions, when I reclaimed bank charges they paid out, but advised they reserved the right to close my account in the future if I had any other problems.
Only problem if they were to close my account is I currently have an agreed overdraft that I use!
But is there no harm in writing to them to complain in the 1st instance?

No. They won't force you, because they won't give you the choice of what to do with it.
It can apply to any aco!!!! that you owe money on, be it in arrears or not.

Hi , Had a letter back from Santander about a Dorothy Perkins card taken out in 1996.I sent proof of form completed inshore with ppi crossed out. They say they sold me the ppi later and I choose it( defo didn't) also I could have cancelled any time before I did in 2005. Also although I wasn't working( they want proof from Inland rev- no probs ) they say as my husband was the benefits would transfer to him??? never heard that before? Is thet right?0

I would ask them how they sold it to you later and to prove it? if it was in your name it has nothing to do with your husband.
Santander are well know for trying to wriggle out of it so i have been told .
write back tell them you did not agree to PPI and if you still get no joy go to the FOS and take no notice of what they say saying the FOS cant help you because they have taken on my case with them for my House of Fraser card.0 -

I am very confused! Husband and I took out a loan with Black Horse and were under the impression that PPI was compulsory. About a year later we took out a loan that cleared the 1st and gave us some extra cash. We have sent the template letters re both loans and received a letter rejecting our claim for the second loan which we have replied to saying that we dont agree with their decision, then today we have received an offer and they say that they agree the first loan's ppi was missold but they still say that the 2nd wasn't. However the acceptance letter is to sign that we accept their offer on the first loan and that nothing is due on the second. We paid around £4500 in totak and this offer is for £1800. Can we accept this and go to FOS or do we have to turn this down in order to take 2nd loan to FOS?0

Did you pay PPI on the second loan and why have they rejected the claim?.
With the first loan as you only paid 12 months on this, you would have had a rebate of the PPI in the settlement figure, as you did not pay the whole PPI then you are not entitled to the PPI you did not pay, how much was the total PPI on this loan?..
If the second loan had PPI how long did this run for or was it settled early and how much was the PPI total?.0 -

Santander are correct about the insurance being transferable to a spouse as this is a store card, you need to send proof of NI and ask for proof that you actually accepted this insurance, when you get the reply from them, depending on what they say, then you can take this to FOS.0
