    hopefully someone here can help
    i took out car finance via welcome cars (i know!) in sept 2007. at the time of signing theagreements the branch was about to close so everthing was really rushed.. i made it clear i didnt want ppi and was sure to make sure it wasnt ticked when i signed.. then at the last moment they relaised they had spelt my name wrong on my agreemenrt! so it was quickly changed and resigned in my haste of resigning and just wanting to get out of there! I signed a form that had the ppi box ticked!

    didnt realise until i got paperwork through the post called straight away and was advised that i could have it removed but would need to go to their office 20 miles away to resign! this wasnt possible die to work and i argued it.. at one point paperwork was coming out to me in thepost.. that never happened..

    i refused to make the payments as they had gone from 165 to 289 with the ppi and i couldn't afford the 289!

    so months past i got the occasional phone call then default paperwork buried my head in the sand and as far as i am aware its now secured as a second charge debt on my property!

    every 6 months i get the standard statement letter because its in default and nothing else..

    finally sorting myself out and wanting to get it paid but first steps would be to have the ppi removed? the balance is currently 13k with ppi and insurances etc when orginal loan was only 5k.

    who do i contact welcome car finance or the debt company...

    Complain to welcome finance, because they were regulated in 2007, and use any and all supporting evidence, paperwork, phone calls, including times [roughly] discussing this, because there should be records of these.
    Because you complained almost straightaway, you have a better case than if you'd left it for months.

  • Hello! I sent the first template letter from MSE asking for copy of my loan documentation from HSBC as I'm pretty sure that I had ppi on it but can't find my documents as it was a while ago. A month later I've received letter saying that after a thorough search the documentation cannot be located. The letter is sent private and confidential without prejudice- which I've never seen before. They go on to say that I don't need documents to start ppi claim of that's why I'm asking for documents. Any advice on what to do next? Thank you!

    I'm not sure if this is the right place for questions but I wonder if anyone can help me! When my husband and I took out our first mortgage with Northern Rock about 10 years ago (2002), we went to see a local estate agent who also offered mortgages. We were told that we had to have the legal and general ppi at the time in order to be able to get the mortgage. To be honest, we didnt think anymore about it and it wasnt until about 5 years ago (2007) that we realised we were still paying it each month.

    In 2007 I complained to legal and general as we had received no correspondance from them in 5 years which was why we hadnt realised we still had the policy. They admitted the only information they had sent was the welcome pack in 2002. As we had changed our mortgage after 2 years, and then again 2 years after that, the cover wouldn't have been enough to cover it anyway had we wished to claim, despite not realising we had the cover! My complaint was dismissed by L&g who wrote back and said if I wanted to increase my cover then they would send me the forms! I promply cancelled.

    So, my question to you all is do you think I have a claim for misselling and should I claim against the original broker for selling it to us in the first place or against l&g for continuing to take the money without sending us any correspondance for 5 years about a policy that we wouldn't have been able to claim against?

    Any help would be greatly appreciated!

    Another one with a PPI claim question... Please let me know if I've posted in the wrong place.

    I'm making a claim to Santander for an old River Island card (it was formally with GE money). It's actually my husband's card so he's signing all the letters but it's me chasing it on his behalf.

    Anyway, after requesting the agreement from them, they wrote saying that they sold PPI over the phone to my husband on 6/12/03, and provided the telephone number. This is the same number my DH gave when he opened the account and it was his father's landline as this is where he was living at the time (teenager). However we had actually moved into our own flat 4 weeks previous to this alleged call and know there was no way DH would have been there to be sold the PPI. We hadn't got around to changing all our contact details since there was no rush.

    So now WE know they are lying but how to prove it??

    Help appreciated on where we go next, thanks!

    Well, unless they have a recording, you can only furnish them with proof of your rental agreement, if you still have it, or his working hours, if you still remember.
    Or you can try telling them the above and see what they say.

    You don't actually say what it was you were paying for either. MPPI is not the same as PPI, so did you have CI cover, unemployment cover, life assurance, buildings insurance.....what exactly were you paying for?

    Thank you. Do they have to have a recording to prove consent or do we have to prove they are lying?

    There is no admission that the only paperwork sent out was at the start. That is a statement of fact. That is normal for insurance. Only when premiums change or cover changes do they then write to you again.

    Your problem on a complaint is that most brokers did not become regulated until Jan 2005. So, your complaint to a broker about a sale in 2002 is likely to be barred as pre-regulation.

    You also havent indicated any wrong doing in your post. L&G reps sitting in estate agents have a pricing model that gives free mortgage advice as long as you buy an insurance product from them. That is allowed.

    So, this is a no go.
