Thank you. Do they have to have a recording to prove consent or do we have to prove they are lying?

You have to prove they have done wrong if nothing they have shows any wrongdoing.

  • Hi,
I took out a loan from First National - supplied by Staybrite/Zenith Windows for three double glazing loans which included PPI - can I claim? And do I claim from Staybrite/Zenith as the paperwork was done via them (the loan application) or with First National themselves, who supplied the loan?

    Thank you in advance!
  • Hi guys,

Been mulling over doing something about my potential to claim PPI for the last few months now, and after reading some of the threads on here, it seems I should have done it straight away.

As I haven't done it before, I just wanted to ask a few questions from like-minded people to get a bit of help before I do so.

In October 2006, I took out a finance loan from PC World to cover for a laptop I bought there, I vaguely remember paying for insurance on it, possibly not required.

I also took finance out from Ford Credit in early March of 2007, and once again, I think I paid for something I didn't necessarily need.

Do these situations come under my right to claim, and is it really worthwhile?

    Thanks for your help.

    Mick

You have no "right to claim", but you can complain about the selling of these insurance policies if you have valid reasons for doing so

Since you have given no indication of mis-selling, probably not.

Hi there, been going over these threads and the main guides for a while now but think I may get better answers here hopefully!

My ex-partner and I took out a secured loan on HIS house (i wasnt named on the mortgage) with Welcome Finance in oct-nov 2003.
It was for £10,000 and it definitely had PPI. The loan was arranged and completed at a local office face to face.
In November 2004 we sold the house and the loan was repaid - just over £14000.

We are not on speaking terms at all. I read in the guide that some lenders pay 1 person all, some part, and some require both parties to apply. Does anyone know where Welcome stand on this? I am concerned that he will have seen the PPI adverts and gone to one of them, so even if Welcome are paying 1 person, would the claim companies have allowed this?

If its the case that he has not applied, what are my chances of getting anywhere with Welcome without any paperwork, and the fact that its before 2005 - does anyone know if they were regulated? Also on a £10,000 loan does anyone know a rough amount of PPI that would have been paid (i know their APR was high and £4000 over the £10,000 that we had would have been mainly interest and early pay off charges wouldnt it?)
I have gone through the success threads but obviously all cases are different so if anyone has any advice it will be much appreciated!
    Thanks :D

A mis sell claim can be put into Welcome, if you have any details on this loan then you can enquire to Welcome about the PPI and they may tell you if a claim for mis sell has been made, as this was a joint PPI then Welcome will need both signatures and any redress will be paid jointly so I cannot see how a claim could be made unless your signature was forged.
You need to contact Welcome or get hold of your ex.
  • Hi there,

I was hoping somebody could help me. I am making a claim on my House of Fraser card ( used to be GE) for insurance that I'm sure I cancelled last year when I was trying to clear any outstanding bills.

I had a reply back today with a copy of my initial agreement ( account cover box was left blank) and the last sentence on the letter says "I can confirm insurance has been applied to your account."

Does this mean I was paying PPI? I'm not really sure what to do next, and would appreciate it if somebody could give me some advice

    Thanks
  • A little help if possible.

This time last year I was refused a PPI claim with MBNA. I decided to take this to the Financial Ombudsman. In October this year the FOS wrote to me to say they would be upholding my PPI misselling and recommend they settle. I received a letter from the FOS today informing me that MBNA will be contacting me with a settlement figure. I had this credit card from 1996 until 2011 and was usually a few thousand pound in debt. How can I calculate if their offer is correct as I no longer have statements as I had paid it off before I pursued the PPI claim.

You can't unless you have records yourself, but it's a bit late to be sending a SAR to see what they have themselves.. Your complaint has been upheld, so they will calculate from what records they have.

You say your name wasnt on the mortgage. Was it actually on the insurance? If not you may not be able to claim.
Also, what are your reasons for complaint? why do you think you have been mis-sold?
