  • Please Help! I'm a newbie, tried to claim PPI back from Barclaycard, been told no because the application was made on-line and I "opted to have the insurance",at the time I thought you needed to have it as part of the card,and do not remember clicking a box, I have the PPI policy document which does Not state that this was voluntary but it does say that I had only 30 days to cancel for a full refund from 01/08/07. which I assumed was the standard cooling off period then your stuck with it. I don't know if I have a claim or not and if so how to go about it!

  • I'm reasonably sure I was mis-sold PPI on a Goldfish credit card, I followed MSE advice and wrote to Barclaycard (who took them over) asking for copies of the original paperwork and included the £1 as suggested.

    After almost 2 months they wrote back saying they could not find the original loan agreement and were therefore terminating my credit facility forthwith. Which I thought was very poor customer service all round.

    Question: How do I go about claiming back PPI without any of the original paperwork?

    Apologies if this has been asked before, I looked but couldn't find a similar question.

    Obviously with an online application your reasons for complaint are far fewer and you are less likely to succeed with a mis-sale complaint when no-one sold it to you. That said, it is possible with a small number of cases.

    What were you reasons for complaint as you didnt say?

    I hope someone can help me, i got rejected my ppi back from barclaycard and its gone over the 6 month period since i have done anything about it.

    Can anyone advise me on a situation that seems to be dragging on. I did post on here the other week that Capital One had had my complaint for 16 weeks and I wasn't sure whether to go to the Ombudsman but I think I was advised to wait as even if it goes to the Ombudsman I would then be waiting a year if not more.

    Anyway Capital One have now written to me saying they now need a further 10 weeks which will then make it 26 weeks that they have held my complaint.

    I have alerted the Ombudsman to this cos I thought if at the end of the 26 weeks Capital One dont uphold my complaint then I may have run out of time to complain so at least by keeping the Ombudsman in the loop I thought I may be doing the right thing (probably not)

    Does anyone have any advice please?

    I would still wait for Cap One. The FOS only uphold 11% of Cap One complaints. The stats are not good if you go to them. By going to the FOS you also eliminate the chance of an auto payout which can happen on small value cases.

  • hi , originally was contacted by cold call from a no win no fee company who took the case on on our behalf, thought we may have a case, the original complaint was for mis-selling but they have closed the case and I was wondering if it would be worth trying the ombudsman as no advice was offered either way !

    Not sure where to start so I'll just jump right in

    I have a 'Joint Midland Bank Mortgage Protection Policy' in the name of Commercial Union Assurance which we took out at the time we bought our house as we were told we 'had' to have it and had no choice in the matter (they wouldn't give us a mortgage without it etc).

    We took it out in October 1986 and have paid it ever since, I suspect we were still paying it even after we paid off the mortgage! It has an expiry date of Sept 2011. The obvious question is can I claim for these premiums over such a long period and where do I start?!

    I am assuming a mortgage is viewed the same as any loan PPI etc

    Thanks in advance for any advice given

    Which seems logical. Back in those days the banks did require life assurance to take out a mortgage. That was allowed and is indeed still allowed.

    Ignoring the fact it is not PPI, why do you think you can claim the premiums back? You havnet given any wrong doing you wish to complain about in your post.

    its not. Its not PPI for starters but there are a number of other differences as well.
