  • Hi guys,

1st time poster here. My apologies if the following question has been asked a thousand times. I've been paying 'Insurance Premium' (that's what it's called on my statements' on my HSBC credit card ever since I applied for this card in 2004. I applied for the card at a branch and remember specifically being told by the lady who saw me when I applied for the credit card that I had to take the insurance, it's just a thing that all customers have to take, basically presented it as if it was a compulsory part of the package. I also remember asking why should I sign up for it if I was in full time employment and not expecting to lose my job. Her response to this was that you should take it just in case.

Now, I don't have the credit card agreement filed away in my files but I have copies of pretty much every single statement since 2004.

Given that I don't have the copy of the credit card agreement, is it advisable to first request the copy of the agreement or can I make a PPI claim without having the copy at my disposal?

Thank you for your advice in advance.

I'm in a similar boat and getting a bit swamped! I took out loans and credit cards with HSBC and EGG (possibly even NatWest) where PPI was added to all. Stupidly a year ago i shredded all my 'closed' account details and now i have no information.

I sent a data request to HSBC who've written back saying they need £10 to do the search, will only search on accounts i send details of (i can only remember 1!) and that the search cannot be associated with PPI (which is something i haven't even stated to them at present).

What should I be doing? My instinct tells me to send £10 and ask for all my data from them? I know for a fact that i was mis sold as i was still in Uni when i took the first loan which they suggested rather than a credit card or overdraft and then scared me into adding PPI - 'just to be on the safe side' - I was totally unsure of it and utterly blagged.

Does anyone have a written blog which guides you through a process where you don't even have the account details let alone T&C's?

ANY help whatsoever is GREATLY appreciated!!! :)

HSBC will only go back 6 years, in your sar letter make sure you stipulate they search for information on ANY loans you've ever had, I will warn you from parsonal experience they are very slow, & will only go back 6 years, they will try to fob you off, so be very clear with what you want, ie information on ppi on any loans you have had with them, asking for account numbers is a ploy to make you go away, as long as you provide name address dob ect they have to comply, do you still bank with them?

Is the card still open? I would just send the claim off with copies of all the statements, along with the filled in fos form, do you have any other reasons for complaining apart from being told you had to have it?

First contact your branch to get the account numbers, fill the fos form in & send it off with copies of any statements ect, send it by recorded mail,I notice from some of your previous posts you get full pay from your job, so you had no need for ppi, also check your policies if you have permanent health insurance ( it covers you if you can't work due to Illness/accident) then you shouldn't have been sold ppi, if you get stuck just ask on here.
    N
Can I ask when the last loan finished

I may struggle to get to the branch to request numbers. Is it possible over the phone, or by letter/e-mail? Sounds stupid to ask this, but how do I go about asking, is there some specific phrasing required?

The bit that i am bothered about/confused by, is I have had the same account from the off, so I would assume they should be able to pull these deatils up, but since it is going back 14 years to the first one, will they still have the details required? I have some statements from 2000 which show a 'loan payment' of £200 per month, but there is no individual number attached to that figure, it merely states 'loan payment'. Do I need specific details of dates loans were taken, values etc for each loan, or can I just quote my account number and let them do the digging from there on how many loans I had, for how much, and on what date? I'm not sure how to fill out a questionnaire if I have no details other than my bank account number?

My accident/healthcare policies cover me for different things. But generally, if I'm off for any length of time for medical issues, I get either a weekly payout, or a lump sum, depending on what is wrong/what has happened. For instance, surgery etc, I get a weekly payout during recuperation, however, broken bones is a lump sum. Then, on top of this, I was/am entitled to full company sick pay.

Last loan finished probably around 2007 ish?? However, on this one, I was somewhat older and wiser, so believe I may have got smart enough to waive PPI, though I can't be certain. On previous loans I was younger and naive, and got swept up in the spiel of how great it was, and how taking it out was in no uncertain terms the right thing to do (even though in hindsight it wasn't required).

By my best memory, my first loan would have been 1998/99ish (Car), then possibly again in 00/01?? (Consolidation). Possibly another around 2003/04ish (Car). then again in 2005/6ish (Car)??

I definitely recall saying at one of these, that ppi was not required, because I remember being grilled about it, why and how I would pay. I do seem to remember the assistant going to check with someone that that was ok, but whether or not, I stuck to that or got talked round, I am not so sure.

I was (very) strongly advised to take PPI out on most/all of these loans, even though I now know I didn't need it. Is this valid enough reason to make a claim?

Thanks for the response. I no longer bank with them but will send the cheque for £10 and specify that I want all the info.

I did wonder if it was a diversionary tactic to test my seriousness and it seems that way.

What information will they provide? Do I get all the t&c's as well as the details of the loans? How precise do I need to be?

How would that £10 spend help you?

It's not. Your complaint is extremely weak. So, it would be easy for them to reject it unless there is a failing on their end or the amount is small and gets auto paid out.

They will give you what they hold in a relevant filing system. It will not include archived items no longer held in a a relevant filing system. You dont ask for specific items. If they have things they will give them. If they dont they will not.

Getting the agreement will not aid your complaint and as you have statements this appears to be a waste of £10.

Hardly a "diversionary tactic" if you made a data request without enclosing the fee, just an unnecessary delay not caused by them!
    To proceed with your intended course of action, there is an excellent template letter here;

Remember to include the £10 and note that they have forty days to comply with your request.

It's this stupid thread where so many conversations are going on at once. The statements were mentioned in a quote on the earlier post but the quote actually belonged to someone else.
