Hi, i received a call last year re claiming ppi, i agreed to look at it, they sent me a letter telling me how much my bank had agreed to pay me and asked that i fill in and send back the enclosed claim form before the cut off date.
I decided i didnt want to go ahead with it and therefore didnt send them the claim form back!
I received one further letter and phone message encouraging me to fill in and send back the form before the cut off date, i again didnt do this becuse i didnt want to go ahead with the claim.
This was november last year.
I am now receiving letters and calls from a debt collecting comp askingme topay a £700 fee for the ppi claim!
Can they do this even though i didnt even send them the claim form back?
You must have given permission for them to do the claim as they sent you the notification from the bank for the amount that you had won, just because you did not sign the acceptance form and send it back to the company does not mean that you don't have to pay them.
If I have read your post correctly, you have not had the refund of PPI from the bank? if not then you need to contact the bank, get the money and then pay the claims co, if you had the money previous then you have to pay the bill, you need to this before any more charges are put on or they take you to court.0 -
It was a small car sales place. I do not understand what a claim has to do with them.
Because they sold the loan and PPI, unless you went into the bank and took a personal loan then you went to the dealer and made the purchase with the money from the bank, if this is what you did then the bank are the ones you put the claim into.0 -

feelingvery low regarding this as I can't see a lot of talk about first plus or does it mean that everyone has been stupid enough to use one of them companies

You put the complaint into loans.co.uk when you have the correspondence from FP that shows L.co.uk sold the loan and PPI, only send a copy of what FP send you.
When you put the complaint into L.co.uk let them know that they are responsible for the PPI on this loan and if they do not accept this claim and look at it then you will forward it to FOS.
Hi Amersall
Thanks for your help. First Plus have now accepted responsibility for selling the loan and have reopened my complaint

Hi,
I submitted a claim to First Plus on May 31, rang them today & have been told it's been upheld!! They wouldn't confirm the amount & said I would need to wait for the letter.
This loan was taken out in 2002 & fully paid off in 2004, they told me it was sold by a broker however dealt with it themselves for some reason. To give everyone hope, I had absolutely no paperwork at all. I simply rang them, gave them my details & they traced me, they told me the amount of loan & PPI.
So what I would say is, don't bother with a SAR with FP just ring them.
Would anyone know how much I'm likely to get back, the loan was £51.000 & PPI was £10,164. Taken out 9 Sep 2002 paid off 19 Jan 2004. Apparently I had no rebate on the PPI when the loan was settled.0 -
Use the ombudsmans questionnaire to send to the company and make a copy in case you have to go to FOS later.
Where it asks "why do you think you were mis sold this product ", you put that this was a Single Premium PPI that was put on the loan to term end with interest and you were not told the full cost of this policy or the unfair rebates at the point of sale.
If you win the PPI and the interest is given back to you plus the 8% you need to be
"put back into the position that you would have been had the PPI not been added to the loan", this takes care of the interest.
Ive already previously sent this questionnaire to them do i fill it in again and put this in the new one?0 -

My loan with them was 12 years ago, but I'm going to try anyway. I KNOW I had PPI on there, and that they told me when I was applying for it that I had to take PPI to get the loan. I've also read somewhere that if it was a debt consolidation loan, then they DEFINITELY shouldn't have sold me PPI, but it was and they did. In fact, I'm thinking that they actually sent the payments to my credit cards to pay them off at the time, so it's not like they can claim not to have known. Anyway, all it's costing me is a tenner for the SAR, for the paperwork that I just threw out in our last massive clearout
I'll update if I get any progress. Hope you hear about yours soon. Where are you in the process? Have you seen the FirstPlus PPI Announcement page on their website? I can't post the link (prob cos I'm fairly new on this user ID) but if you google the words in red, it should come up as the first result. I was encouraged by this, in that they seem to be acknowledging and accepting blame (not sure if this was put up AFTER the court case; I guess so).
My only grumble if I'm successful is that I just discovered last night that they're part of Barclays. I'm just starting a DMP and Barclaycard are one of my creditors, so it'll probably get swiped for that, but I'm hopeful I'll still get the interest.
Good luck!
Don't send an SAR, just ring them (they're open from 09:00-13:00 Saturdays). I had no paperwork on a loan taken out 11 years ago & they had all of my details. I know they're a terrible company however they have been great with my claim (it's also very easy to get through to them)0 -
Hi I am totally new to this and only heard about ppi recently and have read through a number of threads on this and I am totally pickled still.
I am trying to sort things out for my mum and dad. They have a mortage which they took out with Abbey National in 2002 and a Burton Store card which was taken out in about 1965 and was only cancelled last year. I am wondering would they have any case to claim back ppi. They dont have any documents from the Burtons card but still have the card number. Any help would be greatly appreciated about how to start to investigate this.0
