    If waiting too long, I would think about asking your local MP to write to them on your behalf, they should do this on your request and it's been known to help others that have been in the same situation - with delays.

    i wrote to Captial One using the MMT template asking for the org paper work for a credit card we had for 10 years. The account was closed in Jan but they have quoted they're under no obligation to provide documentation, section 78 of the consumer credit act 1974 does not apply.


    I'm smelling a rat but what do i do now.

    Hi, the FSCS cannot help Claire as her loan was taken pre 2005, the complaint should go direct to Welcome and they will deal with it.

    If she contacts FSCS they will take her claim and then write to her telling her they cannot help, they do this knowing the loan was pre the date they can compensate from.

    They are correct as the account is closed and the info may have been archived, you need to send Sar

    Ask for all information they hold you not just the agreement, enclose £10 and give them 40 days to respond, the agreement may not show PPI as this could have been added at a later date, hopefully you will get some statements to show PPI being paid.

    As you say they robbed us, now there caught out they don't want to pay any money back, the fsa needs to take note of this and other stories like that on here.

    Hi haribo I threatened to issue a county court summons after 7 days they paid up on the seventh day.

    I just received a letter from MBNA saying that although I had PPI, that I called to cancel it and the money was refunded.
    I do not have a recollection of this. They did not indicate in their letter when I made the call and how much was refunded. They also said I am not entitled to any ppi and it is their final response. They also said I should take it to FOS if I am not happy.

    Can anyone please suggest what to do.


    Ha Ha pipped to the post by our lorraine, as she says write and ask for proof as the onus is on them to prove this, if there's no joy fos this despite MBNA's bravado there just hoping you'll be fobbed off.

    A friend would like an assistance please?
    He has lots of debts including cc and planning to do an IVA. He earns about £1400 monthly and all goes on paying bills and cc. He has 2 mortgages - both properties are on negative equity.
    He lives in one with his family and let out the other - rent collected is just enough to pay the mortgage.

    The question is, if he goes into an iva, will he lose both properties, as he does not want to end up on the street with his family?

    What is the best way to approach his debt.

    Hi I always say with this sort of thing it's better to get specialised help like the cab which will be able to advise you, they have a solicitor on hand and i believe you will get a free half hour consultation if you go through the cab
