Can someone please tell me what to do now with my hsbc cc?....I had a response saying I did have cardholder protection ins on my cc for a few months in 2003 but as they do not have records they cannot locate any evidence i was charged ppi premiums??
They go on to ask me to send statements (which i dont have).
They said they are upholding my complaint but cannot do anything unless i send them statements!!

Stalemate angel the problem is if you fos this now they'll probably have to reinvestigate your complaint which will take a long time, as much as a year and the problem is fos might see things totally differently and side with the bank anyway, as i said i'm hitting the same brick wall, the banks know full well that most of us did'nt keep statements.

Hi and welcome to you, the rules are the same really if you believe you've been misold and the ppi was worthless to you then put in a claim, I don't know whether you've been fully discharged so there might be an element of losing some or all redress to the iva but you would probably have to take legal advice or better still at no cost to you pay a visit to your local cab who would be able to advise you further. good luck
  • Now then all,

I have had another letter back for the FOS re my complaint to about MBNA.
"we are very busy at the moment....."
MBNA have rejected me claims twice and also the orignal approach from the FOS and so I am waiting an adjudicator to beassigned to my case.

I was just wondering if this has happened to anyone else and whether or not it all goes down hill from now.
I have won every other case and so beleive that I am entitled to also to a win from MBNA as I didn't and still don't know what I was covered for.

Just wondered if the FOS adjudicator would actually fight your corner?

any advice would be great thanks in advance

Hi Egg chaser the fos are neutral and will look at the merits of the case but in your favour MBNA insured through st andrews insurance many were and the policies in many cases were worthless which is why so many MBNA cases are won, i won a case against them myself.

Well my adjudicator is showing no signs of budging and has just called me to say that although I have raised another couple of points, there is nothing in my paperwork to support her upholding my complaint (who said honesty was the best policy?)

She's writing to me today and I have to email her back and tell her I want it progressed to the ombudsman. I don't see why I shouldn't have as much of a crack at it as the next person and as long as it isn't costing me anything to pursue it, I don't mind.

She kindly advised me that the waiting time for the ombudsman is likely to be 12 months so no point holding my breath. I will progress it and forget about it, and hope for a surprise windfall! Do we have an 'away with the fairies' smiley?

Hi karen whats the name of your adjudicator? progress this to the ombudsman now, they will look a lot more closely at your complaint, the general consensus is that the ombudsman will take the same view as the adjudicator but this was not the case in my situation, Cap 1 are not invincible lovely, although it does seem like that at times, keep your chin up and keep crashing into them, If it had'nt been for our lovely Di here i would have given up at the first hurdle. She persuaded me to keep going and i got them in the end.:):):):):):):):):):):):):):):):):):)
