Hi everyone , just need some help where to go from here, ive had a response from HFC BANK about my claim for PPI from a loan for £18000 back in 2002.
I did originally send them a letter asking for a refund back in 2007 to which they refused. I have reclaimed in February after hearing about the court ruling and finding that HFC were one of the banks to be fined for mis-selling.
In their letter today they have said they will not pay due to the fact my loan was in 2002 and that the fine was for ppi they had supplied from 2005-2009, they also quote that the financial ombudsman will not deal with my complaint because of the time lapse since their last response back in 2007.
Is there anything i can do from here?????

...so RBS have offered me a goodwill payment due to the fact that they have been unable to complete their investigations within the allowed timescale for my NatWest Credit Card PPI mis selling complaint, they have only offered a payment going back 6 years because they are not obliged to hold data any older and I do not have any statements more than 4 years old, my card & PPI goes back 19 years. My question is if I took this to FOS and they upheld my complaint what would I be offered in redress, would they still only offer me the last 6 years PPI back or are they obliged to make a more realistic offer ?
Also has anyone had any experience of a RBS/NatWest SAR resulting in the production of credit card statements going back further that 6 years..?0 -
Hi bit of advice on the following please.
Early Feb i contacted MBNA regarding PPI on a credit card that i have had since 1997. I didn't know i had the insurance and certainly never wanted or needed it. They cancelled the insurance straight away no questions asked when i phoned them even though i only phoned to question it at first. Then said they would log my complaint.
Within a week i recieved a letter stating that they didnt have sufficient info regarding my sale so as such could i fill in the enclosed questionaire.
I filled in the questionaire and posted it recorded delivery which they recieved 2 days later.
A week later i recieved a letter apologising for investigations taking longer than anticipted and they will respond by early April.
Today i have recieved a rejection stating that i may recall that they recently they asked me for further info regarding my complaint and because i havent supplied this they have based the decision on info they currently hold. Basically that i was eligable because i was a UK resident, Full time employed and aged 18-70. When i opted for insurance ( I Didn't) they did not offer advice but provided me with information only so a non-advised sale.
The application was a flyer through the post so i would guess was pre-ticked and the acceptance letter doesnt mention anything about PPI ( i still have this ).
They state this is a final response.
Am i right in thinking this is a fob off? and why would they make a decision without considering my response which they say they havent recieved but have signed for 3 weeks prior to sending me my rejection?
Should i e-mail the chief exec of either MBNA or Bank of America? and what are their contact details and names?0 -

I would print off another copy of the letter you sent supplying them with the extra information they requested, also a copy of any proof you have that they signed for it at their end and ask them to look at it this time, otherwise you will send it to FOS. Give them 14 days from receipt to answer

However, do you think the information you sent them had pertinent information that might have swayed their decision? If that is the case, then certainly reply to their "final" response and make them aware of that. If they still reply in the negative, then you can still complain to the Ombudsman but you'll likely have a long wait.0 -
Hi All,
Recently had an uphold from MBNA (previously Alliance & Leicester) but didn't receive a breakdown of figures so I didn't know what my tax liability was. Wrote a letter to them asking for a breakdown on 20/02/12 and received a letter back today (which turns out to be a copy of the breakdown I should have received before the cheque arrived dated 17/01/12)
On it, it states
"Unfortunately as we are not responsible for the premiums charged prior to your account transferring to MBNA, we are unable to reverse these amounts. However, please be assured that we are liaising with your previous lender regarding this and further clarification will follow"
There maybe hope that it could go back further yet
Card has been with MBNA for 5 years so the year prior to that may still be on recordSuccesses

Hi, ive just recieved a letter from my bank informing me that whilst a have payed ppi on an old account, as the account is over 6 years old they basically won't be repaying me anything unless i have records of the ppi payments... As i definately don't have these and i'm guessing if they did have them, after my claim they no longer will have them, then theres not allot i can do.. Has anyone else been in this position and found a successful way out of it??!!0
