Returned iPhone to seller for repair & still problems.

I would suggest your sister files an Amazon A-Z claim as it was her account the phone was purchased on.
Claim item is materially different and select defective item for reason.0 -
meer - i wasn't angling for a crystal ball answer. I know nobody can provide that. I was talking about chances. Is it really like tossing a coin, or would there be a reasonable chance my sister would win? For example ... if a buyer has a grumble on eBay they're likely to win because eBay side with the buyer. It's not crystal ball, but it's a reasonable prediction. Or is a chargeback really 50/50?

From your other posts and whats already happened, if i were to make a guess, i'd say the chargeback will fail. CC issuers don't "side" with anyone. The seller is very obviously not a reputable dealer in Iphones, i might be doing them down here but if you're spending that amount of money there is no way i would buy from anyone other than Apple. It's too much to risk. But thats just my own opinion.
The best thing you can do is speak to your CC issuer for their advice. By actioning a chargeback at least the seller is aware that you're no going to let it drop and they may even send a new phone (but then they may not !)0 -

Correct me if I'm wrong, but wouldn't the jailbreaking of the handset void any warranty with Apple? I was under the impression that they were quite strict on this.0

Anyway, my sister has decided she'll go to the Apple store to attempt to fix this issue. She doesn't want to gamble with this seller any longer (other than wanting her return postage refunded AND her SIM key returned).
So over to the mobile phones forum i go...0 -
Im not an expert, but I would certainly do a full update through Itunes first, as they might not touch it if they know its jail broken. Good luck, hope your sis gets it sorted.0

I emailed Amazon before i came here. They replied.
They said to my sister to file a claim vs the seller.
Have sent a reply back asking if there's grounds for a claim due to the scratch appearing in my sisters ownership. Obviously the scratch doesn't change the fact that the phone is defective.
Also specified that she doesn't want a repair or exchange, she now would only like a refund from this seller. All trust has gone out the window.
If she has grounds for a refund then great, if not then i don't know why Amazon are advising to pursue a claim.0 -
Apple will take one look at it. see its been cracked open and give it back to you with a sorry nothing to do with us response.
I would return the phone to the seller, inform them the repair is substandard and the condition of the handset is not what you bought - they have caused dust inside and have managed to break it as much as it was before (this is not uncommon, apple products are notorious for not being good after being opened...)0
