The SIM tray key isn't essential for the phone to work, as i mentioned previously, all you need is a paper clip. I can't understand why anyone would pay for one ? It's the least of your problems.

And yes, i would definately have been to the Apple shop and back by now, they're open at weekends too. Is it that your sister is worried that she may have been sold a dud ? If she has, at least Apple will be able to confirm this for her and she can then take it further with Amazon or the seller.

Correct, the key isn't essential, but this is not the point. Either you're not getting the point or you're avoiding it, i don't know which.

The point is, she paid for the iphone, the charger, the earphones, the key, etc etc etc. Therefore it's ALL hers. THAT is the point. She should have what is rightfully hers.

As for least of the problems, it's not a case of setting this in a priority order & then tackling them one by one. How long would that take? It's a case of finding out what the problems are & tackling them all. The issue with the phone [1], the key [2], the postal refund [3].

The seller claims they have now refunded the postal & should be in the account within 3 days. We shall see. If this is the case, then that's 1 problem down.

They also said they will return the tray. An email has been sent back saying it's not the tray that's required, it's the key. If this is sorted, that'll be the other problem down.

Then there's the main problem, which Amazon advise to go via the claims procedure, which she will be doing.

She opted in the end to not go to Apple for fear of wasting a 2 hour drive only for them to either 1) refuse to repair - due to it having already been cracked open (despite what may be said here, i've read cases where this has happened) and 2) replacing the phone at a cost of £150 as was quoted here. Well, she can gain £150 from selling the current phone, so what's the point in that. She may as well sell it & put it towards another phone from a high street store. THAT is her concern.

Right now she wants her money back, or at least the majority of it (which would be more than £150). Therefore she's going to go via Amazon claims.

I fear Amazon claims will allow the seller to offer a repair rather than refund.
  • Amazon generally have very good customer service and they'll operate within the law and probably advise the seller on what to do (as they could be rejected from amazon for not doing so etc).

In regards to the phone.. £355 for a 16GB 3GS... seriously?! (had to be said).

Your best bet from day one was to check the warranty and deal with apple. You were advised of this and you didn't do it, distance shouldn't be an issue. Now the seller has repaired it, you've blown that chance!

Why is the key so important?! A paper clip does the job amazingly well! There's even someone on ebay selling them for a pound!

In regards to selling the phone for £150.. you'll never get £150 for a defective phone.. £50 if your lucky...

Out of curiosity.. have you/your sister checked Apples "Water damage" markers? It would be interesting to know if they've been flagged... There's one in the headphone socket and one at the bottom in the charger port.

This was our concern also, so it was voiced to Amazon. Along with the concern of returning the phone only to never get it back NOR a refund.

Amazon responded to both & said go ahead with a claim. So this is the course of action that is being taken.

Don't worry, i beat anyone on here to it. I'm in agreement, but you can't tell people what to do.

Who said distance isn't the issue? You?
    You're wrong.

    Good for that person.
I'm not explaining it again. It's already been explained, so if you care for a reply to the above question, re-read. In fact it's been answered more than once.

The phone has a low signal in places, good signal in others. Our house is bad for o2 signal anyway, but not this bad. I can get an o2 signal just about anywhere else, so yes, after watching plenty of eBay auctions to get a feel of the price, i'm quite sure it can fetch around £150.

Nope, have never even heard of it, but will look into it. Thanks.

How do you view the status of your active claim?

We've been given a 2 week date of when the claim should be finished. We've no update by email yet, so going into the account, we can't see how you see the status of the claim.

To show that i HAVE searched, Following: http://www.amazon.com/gp/help/customer/display.html/ref=hp_537868_status?nodeId=200783770#status

    We get...
    Viewing the Status

For purchases through the Amazon.com website, you can track the progress of your claim by viewing the order in Your Account. From the order details, click "Problem with this order?" to see the status of your claim.
For purchases from third party websites using Amazon Payments, you can track the progress of your claim by viewing the transaction in Your Account on the Amazon Payments website (https://payments.amazon.com). From the transaction details, click "Problem with this transaction?" or "Problem with this order" to see the status of your claim.

We can't see anything close to "problem with...." at all.

My sister had a reply from Amazon today.

They said that she is due a full refund of phone & postage totalling the £355.

No mention of requiring to send the phone back though, which is odd.

My sister has had contact from the seller asking for the return of the phone. Amazon haven't instructed this themselves. I've also been unable to check whether the money has actually been refunded to my credit card due to AA's stupid opening hours of 9am-5pm, which don't accommodate some folk who actually work. Can't call them on my break time either.

Don't mind returning the phone, but don't want to do it if the money hasn't been refunded to my card.

Also, will my sister be eligible for the return postage refunded a second time?

    That's ok then. Thanks.

This seller is likely to be not best pleased that they've had a refund forced on them. After the runaround last time trying to extract the postage refund from them, i can see them not being willing to pay up this time. Might be worth asking for the money before returning the item & then posting it out.
