Returned iPhone to seller for repair & still problems.

My sister bought a 16GB iPhone 3GS just after Xmas 2011.

As shops no longer did the 16GB, she had to look online. She found a seller on Amazon who listed a brand new iPhone 3GS for sale. They stated that the iPhone had only been taken out of its box to jailbreak & unlock & then put back in its box.

£355 later, my sister was the owner of the iPhone she'd been saving for.

FFWD to today, and my sister has told me that recently her phone has been acting up in calls. When she's on the phone to someone, they all complain that they can barely hear her & that it sounds very tinny.
She has the volume turned up. This also happens whether she's outdoors (so outdoor noise) or indoors.


The question is ... where does she stand regarding this? As you don't expect any phone, never mind a £350 "new" one acting up after a little more than 1 month.

Is she entitled to any sort of refund if she returns the phone?

Or is she out of luck & "tough luck" as she bought from an Amazon seller & about 6 weeks have passed?

    its tough luck, your not suppose to jailbreak or unlock them.

    If she used apple before she would know what this is, and should have known better.

    Not supposed to unlock? How stupid! o2 unlock for £15.

    That aside ... She never unlocked or jailbroke, it was the amazon seller who did. Basically what your saying is I can get 100 iPhones, jailbreak them, sell them, they go faulty real quick but there's no comeback on me because someone "should know" not to buy a jailbroken phone..?

    If that's the case then surely amazon "should know" and not allow the sale of such phones.

    And no, she hasn't used apple before, so shouldnt "know better".


    Any other takers on this as I can't see the above being correct at all. It sounds ridiculous.

  • Was it a trader or private seller? If it was a private seller (ie not a business) you're stuffed.

    Why are you 'stuffed'?

    OP, was the item new and is there a receipt for the original purchase? There is still a warranty on the phone with Apple if its less than 12 months old - you can go in and see the staff in the apple store and see what they can do - you may need to revert the phone back factory to do this though.

    The changing of any firmware on a device voids the warranty.

    And how would you prove this if restored to factory condition?

    On Amazon there is the A to Z claim process.

    If you raise a claim that its not working you will be put in touch with the seller to get their side, you will then have to return it via a trackable means at your cost and then you will get a full refund. However you only have a set time frame to raise a claim, I think its 90 days. That seems your best way of sorting it, and you can just buy a normal iphone thats not jail broken from elsewhere.

    If she doesnt need it to be jailbroken, then restore it through Itunes (after backing it up) then go here:

    Warranty Checker

    put in your serial number, and if indeed it is brand new then it should still be in warranty and apple will replace it with no problems there and then in store
