Alfie... after they let the guy go, hubby went over and told the police officer that their break lights wernt wrking, and he said that he had wished we had told him earlier:eek: they did not check his van, and when we told the police initially that there were no lights or warnings etc, he seemed to pass over that...

The 'ethnic guy' came out of his van calm and cool as a cucumber... It was we going like a banchie saying what the 'F' he was doing... now i would have thought, if someone had gone inot the back of me ( except the mini people as i know who's fault it was) i would be rather vocal....

I am just hoping its not one of these 'scam' people who set up rrod accidents just to claim...the mini people said if that was the case, they would confirm there was nothing wrong with the guy, and it was his fault...

The van guy would not come nowhere near us or the mini owners...

we have both drivers names and adresses

dont suppose you got a pic of damage to his vehicle ??

he cant claim for damaged lights/severe rear end damage as if there was the police would/should not let the vehicle drive off as it would be classed as unroadworthy. i would def ask for copy of notes taken at the scene... and def get your ins co to contest claim.counter claim against them for faulty lights with witness . claim full costs. get mini driver to do same . if mini driver drops it then only mini will cop it which is not nice for them but in reality [legal] they had no cause to hit you [distance rules] unless YOUR lights werent working and that would be his case.

ooo sorry late and that seems a muddle.... do you have the legal package with yr insurance? you can use it without predjudice to fight the bast*rd....sounds iffy !!

Yes i have taken pics of the back of the van, but i cant post them on here because of their number plate...

We will be going up to BB tomorrow, some of HA friends went passed on their bikes, so i should imagine they all know up there now...

The caravan was dropped off in work, and the van is being dropped off here later...

so early in the morning we will have to try and find our tent etc.. we also had our friends tent and bits in the van...as they were going up on the bike on friday....

It was really quite funny....after we told one of the police about the lights on the other van, he went in his car.... wonder if he was going to try and find him

Alfie if you want to see the minimal damage done to the twonks van let me know and i can send you a copy

Watch out for whiplash in a few days CTC, both of you. I got hit sideways by a lorry in May and thought I was fine for four days then the pain kicked in. Hopefully you're both unharmed except for the bruise. I'm still not fully recovered four months later.

It could have been so much worse. Lots of hugs to you both xx

    thanks alexliesy..

I am a bit sore, and aching, but as i told the peeps in the min i will not put in for personal injury etc..

didnt realise whiplash etc comes on a few days later....

hubby and I were talking when he came home about it all, and looked at the pics, and i showed him Alfie's posts, and he agrees we should counter claim against him, I have the mini's contact details, and will tell them what we are going to be doing....If over the next few days, these bruises and aches get worse, then it will be against the van not the mini i will be claiming against...

Can't stress this enough. Both DD1 and DW have had to receive physio for this in recent years, but it kicked-in some days after the event. DD1 is still suffering, over a year later... It's expensive, so don't rule anything in or out yet.

I don't want to comment more, as this is too close to some of our experience. :(

Just take it steady and don't let this spoil your big event, CTC. :);)
