Isn't that a breach of the small claims track ? Surely armed with such a letter they would have no chance of winning, I mean how can they claim county court judgement without going there?

Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

Companies that falsely claim to have CCJ to obtain payment when they dont are generally prosecuted by the trading standards.

    What a dreadful letter.

They claim to have sent Notices to owner as well, isn;t an NTO something the police do before prosecution? More misrepresnetaion?

Trading Standards are worth a punt,
  • It's not even signed. Def worth taking it further.
  • Ok, thanks one and all for the advice. I've called Northampton County Court and they have told me this.

This isn't a CCJ, it's a claim, filed online by Euro Car Parks last week, the 16th of Feb. The reason why i haven't received any court papers is because they probably went to my old address, which Euro have CC'ed on their original letter, as well as my new address.

The court official has asked me to submit a defence, either via email or by post. The Court have now amended my address to the correct one.

I would welcome all advice on how to state my defence, and thankyou in advance.
  • When you receive the claim, I will need to see what they have alleged before I can assist you in preparing a defence. If you want to PM me maybe we can communicate by e mail on this one.

It is very difficult to see how they can make anything stick. I am assuming, thus far, that you are a genuine poster and not a stooge- no offence!

Well, I did describe them as "dim" and see no reason to change my mind. They have said the Defendant is the registered keeper of the vehicle. That is doomed. The only person they could have sued would have been the driver. Not difficult to defend, in my opinion thus far.

And yes, they have described it as a "county court judgment" when it is nothing of the kind. Amateurs.

If they have filed papers to your old address yet sent letters to your new one, then that is a deliberate attempt to mislead the court by concealing the evidence from the defendant.
That alone will take some real explanation in court.
