If you do send a LBA, also include the landowner/agent in that action if it's different from the retailer, I think they could be liable as well . You know the person driving, they are not considered disabled under the equalities act are they ? Anything like diabetes or arthritis or if they are long term ill could be considered disabled. Be another thing to add.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -

Yes I'd like to see their evidence that the keeper was the driver on each and every of the 31 occasions ..which is what they need to do if they want to run this as one single claim against one named individual ! What a bunch of plonkers.
Even IF they could prove 16 out of 31 does it follow that the other 15 are the same person ,could all the other 15 not just as easily be the keepers partner ?????
I think these guys need to get some of that proper legal advice that the PPCs seem keen to advise harassed keepers to get !!!
Of course if the OP has posted accurately and they have issued their invoices to the "Registered Keeper" in their own words then they have shot themselves in both feet as we all know the RK has no liability and to suggest otherwise is nothing but blatant fraud.0 -
Ignore everything apart from a letter from the court.
They're entitled to tell you they have submitted a court claim. It would be potentially fraudulent to state they have submitted a 'county court judgement' (unless they made a claim, got no response and applied for a default judgement).
Option 2 would be to draft a letter before action and send a copy to Sainbury's and Euro.0 -
Thanks everyone for your invaluable advice.
I'm posting the letter here, and at pepipoo as well. I'll consider my response carefully, and would welcome all input.
But as a new user I'm unable to post a link, can I DM someone ?0 -
Host on tinypic, take the url for message boards and copy it onto a post but remove the http bit. Good browsers put it in anyway.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Start by making a full list of everything they have done to date. This will need to be recapitulated on the letter before action. More for Sainsbury's benefit than ECP's. They aleady know, lol.0

Thanks !

I would have thought that letter a bit dodgy, pretending to say they have had a court judgement when its pretty certain they have been nowhere near one. Did they provide the schedule that was supposed to have been attached? If so, please post as well.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I guess they mean they reckon they have submitted a Court CLAIM rather than Judgment, as they have mentioned a Court fee so that is how I read it? They cannot even get that right! Wonder what the particulars of claim have been stated as on the claim, if there is one?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
