TCP ticket for parking in a partially marked disable bay at supermarket

just went to asda to get sister card for passing her drivers test was literaly gona be 3 minutes. went to park thought id parked in a family space coudnt see properly with the sun. so got out car noticed tcp guy at mains doors looking bout then staring at me as i walked towards him he didnt say a thing. when i returned few minutes later seen him walking around cars then looked over hed give is a ticket, i opened it up and it says parking charge 70pound or 40 if i pay it straight up. parking in a disabled bay, i now i shoudnt of parked in the bay but didnt realise but surely the guy seen me park should have said straight away you cant park there mate its a disabled bay i literaly walk feet away from him. and i would of moved straight away. if it have been a real warden and seen me do it he would of told me to move it. was going to pay because i thought it was like a actual city of sunderland parking fine. but after reading these comments then looking on the back of charge sheet it says nothing to do with sunderland just scottish address up perth. also i went onto the appeal website and has an icon to appeal or pay clicked it and the only thing its says is that it wants your payment details up before appealing i think not am not that daft, that way they'v already got me details handed over to them on a plate. whats the chances of this actualy being taken further like to court any ideas.0

You are correct. If the parking attendant (who's not a warden) had been doing is job properly of traffic management then he should have told you to move on. The only ones that should be facing court are the car park owners for harrasment, as they are jointly liable for the actions of their contractors.From the Plain Language Commission:

The Blue Badge scheme doesn’t apply to private car parks. Blue Badge holders don't need to display it. Anyone, who’s disabled with a long-term condition under the terms of The Equality Act 2010 can use a disabled parking bay in a private car park.
The Equality Act doesn't say that able-bodied drivers can't also use disabled parking bays. OK, maybe they shouldn't, but they can.
However, the terms & conditions for private car parks usually state that you shouldn't park in a disabled bay without displaying a Blue Badge. This, in itself, contravenes The Equality Act.The acquisition of wealth is no longer the driving force in my life.

I recieved a penalty notice from TCP for parking on the pavement within the car park seen loads of drivers do it, i forgot to pay the forty pounds which was doubled to 70 and now 140 pounds due to me working abroad the debt recovery letters are in should i ignore this or pay thanks in advance for any advice.0
