UKCPS ticket. URGENT help needed. Threatened with court.

    Of course if it wasn't from the Police or a Council (or Northern Rail, they are the only other ones to beware of as they issue real penalties).

    On that Sticky, apart from the pictures of the tickets, none of the 'letter' ones work for UKCPS?

    It just means there were some pics there but hosted on a time-bound site and they've gone out of date I think.

    Just tick off each letter you get that matches the pictures - do NOT just look under 'UKCPS' when you get a debt collector letter, look for that letter shown on the top thread listed under another PPC. All these companies use the same old debt collector letters (usually Roxburghe or Debt Recovery Plus or whatever).

    For any newbie who isn't used to forums, it is only two clicks away to see the top thread (see my signature).

    Where they "win", it's because they issue claims against people who have moved, so they never get the paperwork, and the judgment is entered on default. Of course they don't get any money for this, but they crow about it just the same.

    Sorry, I'm not trying to be thick here, but I'm a bit confused...

    What's the difference between a person moving and never getting the paperwork and all of us getting tickets and ignoring the letters? If we're not acknowledging receipt or appealing with UKCPS directly then are judgements going to be entered on default?

    OK. The letters that come directly from the parking company are meaningless and you ignore them. They present no threat.

    However (and it is exceedingly rare) a company may have a stab at taking the matter to court. To do this, they have to lodge a claim with the court. Usually its done online.

    The Court then posts a copy of what has been claimed to the Defendant (the person they are claiming from.)

    The Defendant has a set period of time to dispute the claim, and it would then be sent forward to go to a hearing.

    However, if, of course, what is posted BY THE COURT never reaches the Defendant because he has moved, then he will have no idea that any claim has been issued, and so will not respond within the period allowed.

    When this happens, the person who made the claim can ask the Court to find in his favour "in default", that is, because there was no response or denial. This counts as a judgment; though it is fairly easy to have it cancelled later if the Defendant learns what happened.

    However, the sad Parking Company claims it as a "victory" even though in fact they won nothing at all on merit.

    But it's as we always say; ignore any letters from parking companies/debt collectors; but act immediately if you get anything from a County Court!

    We advise to ignore the PPC's threatening letters. Ignore these and they eventually realise that they are throwing good money after bad.

    However, if they actually do make a claim to HMCS and they (via Northampton County Court) write to you, then that's a whole different ball game. Ignore these for any reason, and the court will have very little option other than to find you "guilty by default". The legal system doesn't do draws. PPCs love this scenario, because they get to "win", without exposing their actions to unwanted legal scrutiny.
    The acquisition of wealth is no longer the driving force in my life. :)

    If you ignore the letter from the court, is there any downside? Will they chase you up to get money?

    If they don't, and you lose by default, does it actually have any effect on you personally?
