BUT the snail crawled into the returned (for refilling - remember that?) ginger beer bottle which then was not cleaned out before being refilled with Ginger Beer; hence the subsequent illness - and the start of Consumer Rights!Ooh it's like Donoghue v Stephenson (1932) One of the most wide reaching cases of our time. Though Mrs Donoghue got gastro enteritis from a decomposed snail in a bottle of ginger beer.
In this case it can be reasonably foreseen that naturally-grown products will have insects in them and while the company producing the goods will have systems to remove foreign bodies they are not infallible and a court is VERY unlikely to find in the favour of the consumer in this (or similar) case.
