However (opinions invited) if it is right that this company keep 90% of the ill-gotten and only pass 10% to the landowner- isn't that an inevitable admission that the landowners loss is very small and that the balance kept by the PPC is a "fine"?0

To here? Just set up a photobucket account to upload my letter to the sticky. Don't know how long I have to wait to post links though being a newbie0 -
I think if you deliberately leave a space after the http: the system doesn't recognise it as a link, and you can post it, we can take the space out again to access the site?0

Will give it a go. I accidently scanned my letter to .pdf instead of .jpg yesterday so will redo that and get it on here in the next day or so hopefully. I should get a chance to pop back to the letting agent and get a pic of the sign this weekend too. Don't see any reason why leaving a space wouldn't work so will try it and see what happens0

Henner - do you understand the legality around contract law that makes this charge unenforceable?0

I have just sent the link to my letter to Crabman so hopefully it'll be up on the Sticky soon if this doesn't work.0 -

Well yea, I think so. Over the last few days I've looked at what people have posted on here, done some googling, looked on this forum, at the consumer defence league and other forums on this subject and watched the Watchdog and other clips online relating to these things. I believe I understand the principle under which they try to issue these charges.
Correct me if I’m wrong but I think I'm right in saying they put signs up wherever they feel like it and by parking in a place which is considered to be covered by their signs you are supposedly entering into a contract with them. They then say that the contract has been breached for whatever reason they put on the note that someone sticks to your windscreen or sends to you in the post. They then proceed to try to extort money from people like me who don't (well didn't) know any better for the financial gain of the PPC rather than the loss suffered by any landowner who’s needs they claim to be serving and who’s losses they are claiming to be trying to recover.
As for the nitty gritty of contract law I am no expert as can be seen in my previous flailing posts worrying about what could happen to me by not paying the ridiculous amount of money they want to take from me.
Could I stand up in front of a legal expert and go through a blow by blow account of why the legality of contract law makes their charge unenforceable? Not right now.
Do I think I've read and been told enough to rest easy in not responding to them and their fanciful demands and not worry about anything that lands on my door mat from these people over the next few weeks / months? Yes
I can see why people call PPC's chancers, why as Post #17 says these contracts are 'highly dubious' and I can reason all of the arguments on here as to why they couldn't make the ludicrous charges they try to put on people actually stick.
Having learnt a lot over the last few days I am feeling much happier about my situation. In spite of what I thought were the problems I was facing from my first few posts I now realise that I was simply a victim of naivety and my desire to be law abiding and being preyed upon for these things.
I assume, but don’t know, that letters will continue to land on my doorstep from the PPC but when they do they will simply be kept, scanned, posted online and put on the Sticky here where other people have posted their letters etc so that hopefully other people don’t make the same mistakes I did by giving these guys any credence.0 -
Hi,
Does anyone have any experience of dealing with Parking Eye and owning a company car?
I have just received a 'recharge invoice' from my leasehire company just for processing the parking charge (which was the first thing I knew about it). I contacted them and they sent me an e-mail showing me the fine which showed photographs of me entering and exiting the car park. The car park had a maximum staying time of 1 hour 30 minutes and I stayed for 1 hour 40 minutes.
The leasehire company say they have give the company's details to Parking Eye so I suppose they will reissue the invoice to the company.
The question that I have is if I chose to ignore it (as seems to be the advise here), will they try to pursue the company rather than me as an individual as this could get rather embarassing??0 -
The only person they could possibly found a case against would be the driver, April. And if you have read the above you will realise that ain't going to happen. Not after their last disaster in which they recovered £15 and spent well over £4,000 in costs which the judge refused to award.
They cannot possibly take any action against the lease company. The leasehire company were under absolutely no obligation to respond to Parking Eye. They could and should have ignored them, but it seems a lot of leasing companies arte not wise to this scam and confuse them with legitimate tickets issued by councils.0 -

April,
It will be different for a company car, but if the lease company have paid it then as it is not a legitimate fine then you don't have to pay it. Neither should the lease company be paying these speculative invoices. Take a look at this thread which relates to your situation:-
