Bought goods from Peacocks but can't get refund?

    Yes it will. The OP ordered a size x and got a size y, the label size is irrelevant. Its like me ordering a red car, and they send a blue one, but its fine as the label says it is red.

    SOGA , item not as described, it is faulty. Chargeback can also be used for the same reason.

    Sorry if I've missed that post but the OP said that it didn't fit and stated they got what they paid for. Never mentioned wrong size being delivered.

    If that is the case, then a dispute is possible via the Bank but if not then no grounds sorry.

    Does this hold true when the company is in administration though?
    I think the company being in administration changes things substantially.

    One thing that suprises me a little is that no-one appears to be able to give chapter and verse.
    I would have thought this scenario would have happened before.
    They are not the first company to go bust.

    It wouldn't hold true when the company is in administration because the Bank claim the fees back from the company and VISA if applicable when they carry out a dispute for you.

    However, because she ordered before they went into administration there "may" be grounds for a claim under different circumstances but not for this one unfortunately.

    Whether you paid on Debit or Credit card wouldn't affect your ability to claim/dispute/chargeback on anything under £100. Section 75 is only used when a company is in administration or no longer trading and can't afford to refund the customer for faulty/damaged goods, fraudulent purchases or goods/services not provided.

    Long story short, is you're stuck with them which I know is a pain because technically you're at a financial loss at the items are useless to you but Peacocks have done everything correctly.

    Why not cut your losses, put them on ebay and give 10% to a charity? At least something good may come of your own misfortune.

    Thank you very much. I paid £9 each for two vest t-shirts and £12 for a thin jumper. I'd be really lucky to get £2 back on each of them so I'm sorry but I woudn't be donating any of that to charity. I've lost enough, and whilst I am a very charitable person, I have a problem with my central heating and that comes above charity donations just at the moment.

    Really? So can you tell me why my wife is anywhere between size 14 and size 18 depending on where she buys the clothes from? There is to the best of my knowledge no Standard for sizing womans clothing.

    Every woman on this planet knows clothing sizes can vary widely, even from the same seller.

    No but there is usually a size guide in all catalogues and websites that give the measurement in inches/cms.
    So you should be able to tell whether it's the correct label or not.
    You wouldn't be able to say it was faulty under SOGA if it met their own definitions.

    In this particular case (administration) as there is no money to go around I don't think it makes any difference unless more than £100 was spent on a credit card.

    The Company you bought them from is now in admin. and that changes everything...you ordered the wrong size and they delivered it? You got what you ordered and I suspect no refund or exchange will happen.
