Bought goods from Peacocks but can't get refund?

Hi,

First of all, I apologise because I have no idea which topic this is supposed to be in.

I bought some clothes from Peacocks online a little while ago. They arrived before they went into administration, but only by a day or two.

Some of the items don't fit, so I took them back to the store and was told they could not refund or exchange.

I've got £30 of clothes I don't want because they don't fit and can't afford to lose that amount of money. Where do I stand legally?

    If you bought them online you can return them under the DSR within 7 days of receiving them.

    If they were delivered more than 7 working days ago then I'm afraid there isn't much you can do. They are in administration so will not offer any refunds or exchanges. Your only hope might be to wait and see if a buyer is found for the group. If they continue trading then they may start to offer exchanges again, but there is no guarantee this will happen. You could always try to sell them on Ebay but I doubt you will get anything like the price you paid for them.

    Sorry I think you are going to have to write this off, but might be able to recoup something on ebay.

    Returns

    Goods sold before the appointment of the Joint Administrators cannot be refunded or exchanged. The customer may have an unsecured claim against the Company in respect of such goods that are defective.

    Please submit any such claim addressed to the Joint Administrators Deirdre Cox, KPMG, Arlington Business Park, Theale, Reading, RG7 4SD.

    Defective goods sold after the appointment of the Joint Administrators may be exchanged, provided that they are returned within 14 days of sale, together with the original receipt.

    The Company will NOT in any circumstances refund or exchange unwanted goods.
    I understand that none of us foresaw this, but if you really can't afford to lose money like this then you would be better off visiting shops and trying clothes on before you buy them.
    I know in one way that sounds like a statement of the obvious but I've lost money on a giftcard and if I'd forseen this I would have paid in cash.
    Now I know I will not use vouchers in future.

    If you bought with credit card, you might be able to raise a dispute, if you are quick.

    another vote for section 75 credit card claim (assuming you used a credit or visa debit card)

    The card issuer is liable if the retailer goes bust and therefore can't fulfil his legal and/or contractual obligations

    Contact your Bank. You may struggle though as you got what you ordered and it's not faulty.

    Section 75 is no good here - the value is too low.
