    Received letter today from Dept Recovery (cozenage)!


    We are a member of the BPA (bla bla) and adhere to its code of practice. As a registered keeper it is important that you inform us immediately if you have sold/hired the car. If you were not the driver, please (please, please!) provide us with the name and address of the person who was driving the vehicle at the relevant time (..,no chance..!). This is important (to us) so that we can (get our money and) avoid pursuing the wrong person.
    The BPA code of practice states that “the courts do not look favourably on motorists or consumers who try to withhold information from operators (unemployable chancres in my opinion) when it has been asked for with genuine, reasonable and proper cause” (aye right!)
    Accordingly, if we do not receive (our increased amount) full payment or contact from you with your proposal for payment, this matter may be passed to our solicitor to commence County Court Proceedings.
    (Why don't we just do that right now ;))

    They dont look to favourably on VAT dodges, and claims that have no substance at the moment either!;)

    The problem lies in the fact that some of these companies repeated the lies so many times that they forgot they were lies, and thought they were true. Back down to earth with a bump, then.

    This is trite civil law. Google private fines penalty clauses unenforceable.

    Not sure if government websites would provide clear guidance between law and civil matters but the links and advice here :T are all we need to legally challenge this scam.

    Parking a company vehicle where he should not, then refusing to pay the penalty charge and causing needless work for a.n.other members of staff.

    That is very seldom the case. If these charges were for a legitimate parking fee, then all well and good the company should pay the parking fee.

    These charges are penalties no matter what the PPC call them, they are trying to penalise the driver for breach of contract. The remedy for breach of contract (if one did exist) is to put the the contract holder back into the position they were before the breach.

    So if its a free car park the remedy would be £0 and you could not legitimately charge an admin fee for chasing £0.

    If you owed them £5 for parking they could charge you £5 and a reasonable admin fee.

    However they don't they jump in at £60 £75 £80 rising to all sorts of silly amounts.

    Would these companies pay up if a supplier sent them an invoice for £80 because their cheque was overdue? There are remedies for late payments of legitimate debts, but you cant just think of a number and claim it.

    These companies rely on people making a mistake, parking slightly over a line, not displaying a blue badge, staying a few minutes over the allotted time, stepping off site for a few minutes. The difference is they need to issue invoices to make money. So the control of car parking is not the issue the increased stream of revenue is!

    I once had a fleet of trucks and vans, I would never dream of paying these charges in fact I used to have a laugh with the drivers and wind the PPC up, but then I just ignored them, as it wasn't much fun mocking the afflicted!
