Custody release?

Hi,
please don't judge me.
Basically I had to call 999 to get my fiancee removed from the home for domestic violence - he punched me twice in the back, was screaming at me and I was terrified. I locked myself in the bathroom and phoned the police, while I was on the phone he was punching in the bathroom door.
When they took him away last night they told me he would be home in the morning when I offered to give them his medication which he needs to take every morning. I got in touch with the station to find out if they had a time for me and they said they didn't know yet but that it would def not be this morning. They didn't even know if it would be today!
I did not make a formal complaint against him, from what they said last night I thought they would just hold him overnight, interview him and release him but I am worried at the conflicting information I am now getting.
Does anybody have any idea when to expect him? I've never gone through anything like this.
I'm now worried as he does not have his medication and from counting them he hasn't been taking them as regularly as he should which would explain the outburst but I do not want him in there without the pills! (He has mental health issues and they help to stabalise his behaviour)
Please don't tell me how I need to get out, I am wanting to try and work things out and get him to his counsellor and to his doctor but I can't do that at the moment and I am worried at how he is doing in there.

As he has MH issues custody staff would have wanted him seen by a HCP or an FME for a fitness to detain, fitness to interview and check if he needs his medication. Did they ask you bring his meds in?
What's his MH condition if you don't mind me asking? If he's heavily reliant on medication then he won't be able to be interviewed until he's had that as a solicitor will say without meds it could affect what he says in interview.

I have no idea when you should expect him but is it possible that, due to not taking the medication, the outburst may have continued/escalated while in custody? Would he even have mentioned the meds if he isn't currently taking them voluntarily? It may no longer be as simple as dealing with what occurred at home. Personally I would be delivering the medication and details of the current prescription and his counsellor etc to the police station so that there can be no unreasonable excuse for him not receiving appropriate care.Eat food. He has bi-polar type 1 and sociopathic tendancies, he is currently being assessed for early-onset dementia as well. He was probably drunk when he was picked up - or at the very least 'tipsy'
Have just phoned them to say I'll come round with his medication and can they make sure that he has taken it.

If he's been arrested, even if you haven't made a formal complaint, he may still be charged with an offence. I would imagine that advice will be sought from the CPS duty solicitor. You're views are just part of the decision making process in domestic violence cases as the CPS have a duty to your safety and others future safety when making decisions.
If there is sufficient evidence, even without your complaint, and he is charged then I would imagine that he will be given police bail with conditions not to contact you directly or indirectly and a date will be fixed for a hearing at the Magistrates Court.
If a decision is made not to charge then he will be released without conditions (I take it he's not so unstable as to warrant being sectioned).
I hope this helps. There are many, many victims of domestic violence who end up not making or withdrawing complaints who find themselves in ever increasing violent relationships. The CPS domestic violence policy is there to help those people and not to hinder them.0 -
He wouldn't be sectioned but likewise I do not want him to be charged - there is no evidence really - apart from my statement, there are no marks on my body as he did not hit me hard. I would like to work through it with him and go to counselling together and give it a bit of a shot... I know that sounds completely stupid though!
If he is released with conditions of not being near me would that leave me homeless as it is his name on the lease?

It's still early. Like you've said take his meds in and just wait to hear.
It can take a long time as the custody staff have to be satisfied he's fit to be released (putting the charge aside). They are responsible for his welfare so are not in a habit of releasing DPs (especially those with complex MH issues) without a full assessment. This can include an Informal MHA and that takes time.0 -
