  • Well I have just checked on the Royal Mail website to see if my letters had arrived, both were signed for this morning. I will leave it a couple of days and then ring them to confirm that they have received them and confirm again that I am appealing their decision.
  • Rang DWP first thing this morning to ask about appeal letter and Dr`s note, they confirmed that they had received both, also told them again that I was appealing their decision. They seemed surprised that I "knew" what I was doing, their words not mine:) I just told them that I was receiving advice from CAB, but it is the help/advice on here that has really helped me, so once again thank you:T

    I will update the thread whenever I have something worth posting about my case.
  • Just been informed I am being sent a questionaire form in the next 14 days to fill out and after reading this think I will be going down your route blondee55 ..been on IB since the mids 1990's I also got medically retired. I am really anxious about it all but just glad I read this thread ..thank you . Will also let you know what happens after I get my form
  • I have now received my "last" IB payment, can anyone please tell me what will happen next with regard to the payment of ESA Assessment benefit? I have sent my Dr`s note in early to try and ensure the payments don`t stop completely but I am in the dark as what to do next!

    My friend had won appeal without tribunal as the decision was award from 0 point to 15 points down to ATOS errors. She had now placed in support group for 10 years because she blinds on both eyes and had guide dog. She been waiting for 6 weeks for DWP to decide her appeal is award 15 points and throw away the 0 point ATOS had scored her for both blinded.

    ATOS should be sacked!

    She will recieved backdated payment of £1,432.17

  • To be honest I don't think anyone here can answer.... you've asked them to reinstate ESA at assessment rate.. you've sent them a sicknote to qualify for it... you've got confirmation they've received both and so it is in their court regarding administrating efficiently. They'll soon carry out an automatic reconsideration to see if they can change decision.

  • Update what is happening to me I am really upset and angry with the DWP. I got a letter from my GP and reports from the hospital and sent them off special delivery cost me £6 Checked on the website of Royal Mail and yes been signed for so i rang them a few days later and was told nothing has arrived. So was put through to this lady and she checked the website by me giving her my Royal Mail ref no. She said she will look into it and get back to me today she phoned me to say it has not been found and will have to get another one from my GP. Then was told i have to also get a sick not for 3 months untill i can get back to work i said in the GP,S letter it says i will not be fit for work for the foreseeable future now to me that tells them i am not fit but still have to do a sick note every 3 months. Was told soon as the letter and proof has been seen i will get my money till the appeal is done. This was all done on the 14th Feb and now i have to start over again. Anyone got any ideas what i can do because this is not my fault and has really delayed my appeal and it is making me ill with worry. The DWP is so fast to stop the money and we get told our money will stop right away. But when they do somthing wrong if is so different. I am sick of it all right now and just don't know what to do as my GP is on Holiday till next week and cannot see her till a week today. Any advise will be good right now as i dont want to upset them to much. And one ore thing i have asked so many times to the full report and still not had it.:mad:

    I've just got up so trying to clarify your situation. Not sure if you've actually indicated in writing to them that you wish to appeal... but presumably they'll need that (before reinstating assessment rate ESA) along with a sicknote (perhaps the document from GP may be rejected as it doesn't specify dates or duration?)... make sure you're using the address at top of DWP ESA letters. Unfortunately they really seem to be giving you bad advice and seem to be letting you down regarding processing what you send to them and it is getting messy now. The DWP can face delays in processing mail it receives.

    I just hope you can get this resolved ASAP and make sure you don't fall foul of any deadline for submitting request to appeal (in letter or using GL24 form). Make sure you focus of the descriptors for the benefit.... GP sicknote is used for qualification for assessment rate while awaiting appeal but if your GP is to help with your appeal then ideally he needs to supply information relevant to the descriptors. Also important, given this is the DWP we're talking about, only send them original documents if that's what they request.. hospital reports and the like can be worth their weight in gold (well probably more in actual reality) but can easily go astray. It may be that the reports have been duly received and will be placed on file but they may not be accepting of the format of GP document as indication of current entitlement to assessment rate.

    I notice you were given misleading advice from DWP at top of page regarding GP reports. There is a form (ESA113) used regarding GPs... although it would presumably typically be ATOS that would request its completion if they felt it was necessary (before deciding if face to face medical was necessary). In my current reassessment they have sent one to my GP. The form may be useful for your own use... perhaps you could guide a medical pro involved in your care/treatment to complete one or it could be used as a guide. www.dwp.gov.uk/docs/esa113-interactive.pdf
